Détermine la procédure de plainte ou de réclamation des gens de mer portant sur leurs conditions d'emploi, de travail et de vie à bord. La procédure est fixée pour le cas où les plaintes ou réclamations sont formées auprès des responsables présents à bord du navire et pour le cas où elles sont formées auprès des autorités extérieures au navire. Fixe également les modalités de dépôt, de conseil, d'assistance ou de représentation des gens de mer et d'information sur la procédure.

Décret n° 2016-303 du 15 mars 2016 relatif aux modalités d'exercice du droit d'alerte et de retrait des gens de mer à bord des navires. -

Organise les modalités d'exercice par les gens de mer et par la section des gens de mer du comité d'hygiène, de sécurité et des conditions de travail des droits d'alerte et retrait à bord des navires. Le droit d'alerte dévolu au comité d'hygiène, de sécurité et des conditions de travail est exercé à bord par le délégué de bord en cas d'absence de section des gens de mer au comité d'hygiène, de sécurité et des conditions de travail ou d'absence à bord de membre de la section gens de mer. Le droit de retrait des gens de mer s'exerce en tenant compte des impératifs de la sécurité en mer.
