    Equal Pay Act; Interpretations Rule (29 CFR Part 1620)

    These amendments are the final interpretation of the Equal Employment Opportunity Commission regarding the Equal Pay Act (see Fair Labor Standards Act (consolidation), LS 1966 - USA 1). Inter alia, they delineate the basic applicability of the Act and define wages, wage rates, and equal work, in addition to various key jurisdictional terms. They provide guidelines on evaluating the equality of jobs, especially in relation to skill, effort and responsibility. The new Regulations prohibit discrimination with regard to fringe benefits for men and women performing equal work. Other provisions govern certain defences, measures to remedy violations and the relationship of the Act to other equal pay and labour laws as well as to Title VII of the Civil Rights Act (LS 1964 - USA 1 (Extracts), 1972 - USA 1).

Declara el derecho de toda persona al libre desarrollo de su personalidad conforme a su propia identidad de género, con independencia de su sexo biológico, genético, anatómico, morfológico, hormonal, de asignación u otro, dentro de lo cual incluye el derecho de ser identificado de forma que se reconozca plenamente la identidad de género propia y la consonancia entre esta identidad y el nombre y sexo señalado en los documentos identificatorios.

    Declara de interés nacional la lucha contra el racismo, la xenofobia y toda otra forma de discriminación y define como tal a toda distinción, exclusión, restricción, preferencia o ejercicio de violencia física y moral, basada en motivos de raza, color de piel, religión, origen nacional o étnico, discapacidad, aspecto estético, género, orientación e identidad sexual, que tenga por objeto o por resultado anular o menoscabar el reconocimiento, goce o ejercicio, en condiciones de igualdad, de los derechos humanos y libertades fundamentales en las esferas política, económica, social, cultural o en cualquier otra esfera de la vida pública.
    Crea, asimismo, la Comisión Honoraria contra el Racismo, la Xenofobia y toda otra forma de Discriminación y define sus competencias e integración.

Igualmente, dispone que el Departamento de Recursos Humanos de la Intendencia Municipal de Montevideo deberá desarrollar una política activa que prevenga, desaliente y sancione las conductas de acoso sexual.

    Ley de igualdad de oportunidades para la mujer.

    Regula el ejercicio de los derechos y garantías necesarios para lograr la igualdad de oportunidades para la mujer, con fundamento en la ley aprobatoria de la Convención sobre la eliminación de todas las formas de discriminación contra la mujer. El cap. II (arts. 11-17) se consagra a los derechos laborales de la mujer, los cuales incluyen el derecho al trabajo urbano y rural, la igualdad de acceso a todos los empleos, cargos, ascensos, oportunidades y a idéntica reumuneración por igual trabajo. El cap. III (arts. 18-24) se refiere a los derechos políticos y sindicales de la mujer. El embarazo no puede ser motivo de discriminación. Los exámenes médicos para descartar o comprobar un posible embarazo, con fines de aprobar o recharzar su ingreso o pemanencia en una empresa son considerados como lesivos a los derechos laborales de la mujer. El cap. IV se dedica a los derechos económicos de la mujer, tanto en el medio rural como en la artesanía y las microempresas. Se crea el Instituto Nacional de la Mujer y una Defensoría Nacional de los Derechos de la Mujer. Se incluyen también disposiciones relativas a la participación de las mujeres en las relaciones internacionales.

  34. Zimbabwe - Non-discrimination - Law, Act

    Prohibits discrimination on the grounds of race, tribe, place of origin, national or ethnic origin, political opinions, colour, creed or gender with regard to access to public premises or supply of commodity, service, or facility. S. 6 prohibits persons from making statements regarding "racial superiority or hatred" if such statements would endanger the rights, freedoms and reputations of persons in Zimbabwe. S. 10 provides for exceptions to the Act with regard to political and religious organizations, as well as for acts "reasonably justified" in view of physiological differences between genders or in the interest of public morality. Amends the Unlawful Organizations Act (C. 11:13) so as to allow the President to prohibit organizations which propagate racial discrimination. Sets forth penalties for contravention of the Act. Repeals the Public Premises (Prevention of Racial Discrimination) Act (C. 8:12).
