Résumé/Citation: Makes numerous amendments to the Employment Equity Act. Includes amendments to certain definitions. Amends section 6 by extending the scope of discrimination to include discrimination on "any other arbitrary ground". It in particular adds a new subsections (4) and (5) to section 6. Section 8 is amended concerning psychometric testing. Section 10 is also amended concerning dispute resolution with special provisions in the case of sexual harassment in the workplace as well as wage discrimination. The Act also amends section 11 (burden of proof), minor wording changes in sections 15, 16, and 19, section 20 (failure to implement employment equity plans), section 21 (reports), section 27 (income differentials and discrimination), section 36 (undertaking to comply), section 37 (compliance orders), sections 39-40 (repeals both sections), section 42 (assessment of compliance), section 45 (failure to comply with Director-General's request or recommendation), section 48 (introduction of new subsection (2)), section 50 (fines), section 53 (code of good practice), sections 55-57, 59, 61, and section 64A (inserts new section on the amendment of annual turnover thresholds in Schedule 4). Also repeals and replaces Schedule 1 concerning maximum fines and Schedule 4 concerning turnover threshold applicable to designated employers.
