Résumé/Citation: The aim of the Act is to ensure the protection of the rights of workers from a foreign country who have been posted in Estonia in the framework of the provision of services, and fair competition between employers involved in the provision of services. It applies to workers posted in Estonia by their employer for a temporary period. The Private International Law Act is to be the applicable law in deciding what law to apply to the employment contract. The more favourable law (Estonian or law of the other country) is to be applied with respect to employment conditions. The Act also sets out the working conditions to be adhered to, provides for dispute resolution, State supervision of working conditions. It implements the European Parliament and EU Council directive 96/71/EC concerning the posting of workers in the framework of the provision of services.
