Résumé/Citation: Employees have the right to participate in the administration of enterprises and cooperatives collectively or individually. The participation has the form of the right to propose and the right to get an answer to any proposal, the right to be informed, the right to be heard, an initiative right and the right to get an answer to any initiative, the right to joint deliberations with the employer, the right to co-decision, the right to veto a decision of the employer. The further regulation of participation is to be fixed in a agreement between the employer and the employees. Participation is ensured by a enterprise council, a shop steward or the assembly general of all the employees. The enterprise council may not engage in any trade union dispute. The act contains rules in particular on the election, the composition and the duration of the term of the enterprise council and the shop steward, their activities, the assembly general of the employees, the settlement of disputes between the employer and the enterprise council. In case of an employer violating this act, rules of penal law are provided.
