| Résumé/Citation: | The Law revises the legal framework governing the prevention, fighting against trafficking in and exploitation of human beings and protection of victims and it is promulgated for the purposes of harmonizing national legislation with the following instruments: - Council Framework Decision 2001/220/JHA of 15 March 2001, on the standing of victims in criminal proceedings; - Council Directive 2004/81/EC of 29 April 2004, on the residence permit issued to third-country nationals who are victims of trafficking in human beings or who have been the subject of an action to facilitate illegal immigration, who cooperate with the competent authorities; - European Parliament and Council Directive 2011/36/EU of 5 April 2011, on preventing and combating trafficking in human beings and protecting its victims, and replacing Council Framework Decision 2002/629/JHA; as well as for the purposes of optimal implementation of the following Acts: - Law N° 11(III) of 2003 ratifying the United Nations Convention against transnational organized crime and the Protocols thereto, and especially the Protocol to prevent, suppress and punish trafficking in persons especially women and children, supplementing the United Nations Convention against transnational organized crime; - Law N° 57 of 1983 ratifying the Convention for the suppression of the traffic in persons and of the exploitation of the prostitution of others; - Law N° 6(III) of 2006 ratifying the Optional Protocol to the Convention on the rights of the child, on the sale of children, child prostitution and child pornography; - Law 38(III) of 2007 ratifying the Council of Europe Convention on Action against Trafficking in Human Beings. PART I: CONSTRUCTION OF NOTIONS, PURPOSE AND SCOPE OF APPLICATION (Articles 2-5) PART II: CRIMINAL OFFENSES AND JURISDICTION OF COURTS (Articles 6-28) PART III: RIGHTS AND PROTECTION OF THE VICTIMS WITHIN THE FRAMEWORK OF THE CRIMINAL PROCEEDINGS - RIGHT OF VICTIMS TO COMPENSATION (Articles 29-41) PART IV: RECOGNITION, ASSISTANCE AND SUPPORT FOR THE VICTIMS SECTION 1: General Provisions (Articles 42-50) SECTION 2: Special Provisions for Victims who are European Citizens or Third-country Nationals (Articles 51-60) PART V: PREVENTION PROGRAMMES AND INTERVENTION MEASURES (Article 61) PART VI: VICTIMS SUPPORT FUND AND ADMINISTRATIVE STEPS FOR THE IMPLEMENTATION OF THE PRESENT LAW (Articles 62-70) PART VII: FINAL PROVISIONS (Articles 71-72) The present Law prevails over the Laws N° 87(I) of 2007 and 13(I) of 2012 on the Legal Framework regulating the Special Protection of Persons who are Victims of Trafficking and Exploitation. |
