| Abstract/Citation: | Employers have a general duty to create working conditions which do not pose a danger the health without shifting the costs to create these onto the employee. Before opening a workplace, its safety has to be examined. It has to be examined periodically thereafter. The risks of the workplace have to be evaluated. The employee can only work in a condition suitable for his or her work, in conformity with the occupational safety rules and with the training he or she has been given. Specific information has to be reported in case of an occupational accident. Regarding the safety of the workplace, the employer has to consult with the employees respectively with their occupational saftey representatives. Requires the employer to create conditions to allow the occupational saftey representative to exercise his or her rights. The employer who does not comply with the occupational safety requirements and thereby endangers the employees' life or health is is liable to fines. |
