Abstract/Citation: Provides comprehensive legislation regarding labour contracts and conditions of employment.
Chapter 1 contains general provisions. Section 7 prohibits discrimination based on, inter alia, sex, race, citizenship, language, property status, age, marital status, religion, political views, and membership in a trade union. Section 8 prohibits forced labour. Section 9 enumerates rights and duties of employees, including the right to safe working conditions, paid leave, pension insurance, and the right to organize and to appeal to courts for labour protection. Chapter 2 covers procedures to be followed regarding labour contracts. Probation period is limited to three months and employers must give employees two months' notice regarding changes in conditions of employment. Chapter 3 governs termination of labour contracts. Chapter 4 provides for insurance for employees in case of dismissal. When dismissals are the result of a reduction in the scope of an enterprise, the employer must provide severance pay. In such cases, persons with the highest qualifications shall be retained; those qualities being equal, priority shall be given to persons who are soldiers, combatants, refugees, sole bread-winners, or who suffer from occupational diseases or injuries. The contracts of pregnant women or women with children under 3 years of age may not be terminated by the employer. Chapter 5 covers work-books, resolution of disputes, and transitional provisions.
