Consists of a Preamble and thirteen Chapters. Chapter one outlines the political system; Art. 2 establishes Islam as the religion of Afghanistan. Art. 5 stipulates that Judges and Attorneys shall not be members of political parties during their terms of office. Chapter Two outlines the foundations of the socio-economic system, including the protection of private property (Art. 19). Basic Rights and Freedoms are set forth in Chapter Three, which contains a provision against torture (Art. 42) and guarantees the freedom of speech (Art. 49). Chapters Four through Eleven establish the duties of the the branches of government: the Loya Jirgah, President, National Assembly, Council of Ministers, Judiciary, Attorney Office, and Constitutional Council. Chapter Twelve outlines foreign policy objectives, including the fight against Zionism (Art. 136). Chapter thirteen contains miscellaneous provisions, relating to, inter alia, the declaration of a state of emergency.
