For the purposes of harmonizing the national legislation with the articles 4, paragraph 2 (a), 5 (b), 6 paragraph 3, 9 paragraph 3 (a) and (b) and 11 (I) of the European Parliament and Council Directive 2011/24/EU of 9 March 2011 on the application of patients' rights in cross-border healthcare, as well as with the article 4 of the Commission Implementing Directive 2012/52/EU of 20 December 2012 laying down measures to facilitate the recognition of medical prescriptions issued in another Member State, the present Law amends the Law N° 149(I) of 2013 on the Application of Patients' Rights in Cross-Border Healthcare (Amendment).

Article 2 of the present Law amends article 2 by adding new term "Regulation (EC) N° 883/2004" and its definition.

Article 3 supplements 3rd phrase of article 8, (regarding the information provision from the national contact point to patients and health professionals), by adding the following new paragraphs: (i), concerning the standards and guidelines on quality of care and patients safety provided from the Republic of Cyprus, as well as the specific healthcare providers that respect such standards and guidelines; (j), concerning the elements to be included in the prescriptions, as set out in the Annex III of the Law on Pharmacy and Poisons, as amended and replaced and (k), concerning the information framework on the cross-border healthcare provided by the national contact point, through which a clear distinction shall be made between the rights which patients have by virtue of the present Law and rights arising from Regulation (EC) N° 883/2004.

Article 4 amends the wording of article 12 and supplements it by adding new paragraph (e) worded as follows: "upon request, the patients shall be provided from the national contact point with the relevant information on the standards and guidelines as defined by the Republic of Cyprus as Member State of treatment, as well as information on the provisions in force related to the supervision and assessment of the healthcare providers and on the specific healthcare providers that respect such standards and guidelines".

Article 5 amends the wording of article 15 and supplements it by adding the following new paragraphs, (f) worded as follows: "in case a person insured in the Republic of Cyprus seeks cross-border healthcare, the patient's particular medical condition, the urgent nature of the incident and the individual circumstances shall be taken into consideration during the information provision or during the examination of a request subject to prior authorization", and (g) worded as follows: "in the information framework on the cross-border healthcare, a clear distinction shall be made between the rights which patients have by virtue of the present Law and rights arising from Regulation (EC) N° 883/2004".

Article 6 supplements article 21 by adding new phrase (1A) worded as follows: "The General Director, on deciding upon the granting of prior authorization for the provision of cross-border healthcare, shall take into consideration: (i) the patient's particular medical condition, as defined in the report of the Experts Committee and (ii) the urgent nature and the individual circumstances of the patient".

Article 7 amends article 33 by replacing 2nd phrase with new one, worded as follows: "Prescriptions that are issued in another Member State but dispensed by a registered pharmacist in the Republic of Cyprus, or issued in the Republic of Cyprus upon request of the patient to be dispensed in another Member State, shall include at least the elements set out in the Annex III of the Law on Pharmacy and Poisons, as amended or replaced. The provisions of the present phrase shall not apply with regard to the prescriptions issued in the Republic of Cyprus and dispensed in the Republic of Cyprus".
