Summary/citation: The Labour Code of May 15, 1997 and the Occupational Safety and Health Act of May 19, 2009 are the main occupational safety and health laws of Tajikistan. The Labour Code establishes state guarantees of labour rights of citizens and is aimed at ensuring respect for the legitimate interests of workers, employers and the state. Chapter 11 of the Labour Code is dedicated to occupational safety and health. The OSH Act supplements the occupational safety and health provisions of the Labour Code and provides the legal framework for the regulation of relations in the field of occupational safety and health between employers and workers. The powers and rights of state labour inspectors are laid down in Article 25 of the OSH Act. Legal provisions on protection of workers from specific occupational hazards are contained in various separate legislative enactments such as: the "Act on Production and Safe Handling of Pesticides and Agrochemicals”, the "Act on Radiation Safety”, the "Act on Counteraction to Human Immunodeficiency Virus and Acquired Immunodeficiency Syndrome”, or the "Act on Fire Safety”. The Code on Administrative Offences and the Penal Code of Tajikistan provide for adequate penalties for violations of the laws and regulations concerning occupational safety and health.
