Summary/citation: In accordance with the provisions of Law 3850/2010, the employer is obliged to:
(a) Take all necessary measures for the protection of the health and safety of the employees, including all actions for the prevention of occupational hazards, for information and training, as well as for the creation of the necessary organisation and the provision of the necessary measures.
(b) Adapt the measures taken to changes that occur in the work.
(c) Apply the advice of the technicians and labour health inspectors and in general to facilitate their work in the enterprise during inspections.
(d) Supervise the correct application of the measures for employees' health and safety.
(e) To inform the employees of the occupational hazards of their work.
(f) Establish a programme of preventive actions and amelioration of work conditions in the enterprise.
(g) Ensure the maintenance and the monitoring of the safe operation of the means and facilities.
(h) Encourage and facilitate employees' and their representatives' training and learning, as well as adopting collective measures for employee protection.
Also, the employer is obliged to:
(a) Evaluate the dangers to the health and safety of the employees, including, among others, those arising during the selection of work equipment, chemical and biological factors or products, during the physical arrangement of the workplace, as well as all dangers that are related to the manufacturing process.
(b) Take all these factors into account when assigning duties to an employee.
(c) Take care that the scheduling and the introduction of new technologies be an object of consultation with the employees and their representatives, concerning the consequences of the choice of equipment, of the work conditions and of the work environment for employees' health and safety.
(d) Take care that only the employees who have received proper instruction shall enter zones of serious and particular danger. Measures for safety, health and hygiene during work may not entail, in any way, any economic liability for the employees.
