- 2.2 Definition of worker

- 2.5 Definition of occupational accident
  Summary/citation: An occupational accident is defined as an accident suffered by the worker and which has arisen out of work or during work, whatever the cause is.
  It is also considered as an occupational accident:
  
  - the accident that occurred during the round trip between the worker's residence or the place where he/she usually takes his/her meals and his/her workplace or the place where he/she receives remuneration, insofar the course has not been interrupted or diverted due to a personal interest or non-job-related reason;
  
  - the accident that took place during travels when expenses shall be borne by the employer according to the legislation in force.

- 4.4 Surveillance of workers’ health in relation to work
  Summary / Citation: The employer is required to ensure that employees undergo the medical visits and examinations prescribed by national laws and regulations, and in particular, medical examinations upon recruitment, termination and when returning at work, and the periodical and special monitoring ones.
  
  The time taken to carry out the medical examinations and the complementary examinations is considered as actual working time.
  
  The HIV test shall not in any case be required at these medical visits and examinations. However, the voluntary and anonymous testing is encouraged.
