Title Duty of care to domiciliary care workers

Abstract Legal responsibilities for the health and safety of domiciliary care workers are examined. The complex contractual relationship which may exist between the recipient, the purchaser and the provider of the care makes it difficult to establish who has duties under health and safety law. While local authority or independent care providers are required to provide adequate risk assessment and training for their staff, self-employed care workers are responsible for their own health and safety. Examples of judicial decisions illustrate the complexities of the situation.
