Abstract Employers are required to ensure the safety and health of their employees. Failure to do so is an inexcusable fault in cases where the employer knew of, or should have known of, the risk to which the employee was exposed and failed to implement the necessary preventive measures. Contents of this article on the inexcusable fault of the employer: what constitutes an inexcusable fault; legal liabilities of employers in cases of non-compliance with their obligations with respect to occupational safety and health; conditions of waiving liability; financial consequences in cases of employers' responsibility; period of limitation of employers' liability.
