Promoting equality at work in China
The main objective of the project is to improve the legal and policy framework on non-discrimination and equality in employment. For this purpose, the project seeks to increase awareness and enforcement of labour standards on non-discrimination and equality in employment through the development of a compendium of court and labour arbitration cases on non-discrimination and a field study “Discrimination in Employment in China” undertook in 5 different Chinese provinces. The project has also organized awareness raising workshops for constituents and judges on the principles enshrined in ILO Conventions Nos. 100 and 111. The ultimate goal of the project is that constituents agree on and adopt an action plan on non-discrimination
The project hopes to improve the legal and policy framework on non-discrimination and equality in employment by adopting an action plan on non-discrimination. Additionally increased awareness and enforcement of labour standards on non-discrimination and equality in employment is anticipated through the development of a compendium of court and labour arbitration cases on non-discrimination.
The outcomes and outputs will promote progress in respect of the comments and recommendations from the supervisory bodies on the application of C. 100 and C. 111. Specifically, a report submitted to the constituents for discussion will aim to address some of the gaps in China’s current legislative framework on non-discrimination; namely, the grounds for discrimination that should be covered in accordance with C. 111, and the provision of a definition of discrimination. In order to address the supervisory comments on the need to collect information on the situation of ethnic minorities in China and to improve the effective enforcement of legal provisions prohibiting discrimination of rural migrant workers, the report undertaken in Outcome 1.1 will be based on field research done in areas that employ a large amount of internal migrant workers, such as Zhejiang, Fujian and Guangdong provinces in the eastern and southern coastal areas, as well as provinces with high number of ethnic minorities such as the southwestern Yunnan Province.
