This document is a preliminary working paper for the use of the Governing Body and officials of the Office. It records only the Governing Body’s decisions, and not the circumstances of their adoption, except where they were the result of a formal vote. The comments or reservations by individual members or groups subject to which the decisions were made will be found in the minutes of the session. Where an Office publication or paper refers to a Governing Body decision, the source given should be the relevant Governing Body document and minutes, and not this Record of Decisions. 1. The Governing Body approved the minutes of its 279th Session. (First sitting; GB.280/1, para.2)
Second item on the agenda
2. The Governing Body decided that the 91st Session (2003) of the Conference should open on Tuesday, 3 June 2003, and that it should be held in Geneva. (First sitting, GB.280/2, paras. 1 and 2).
3. The Governing Body decided that, in addition to the standing items that the Conference would have before it, the following items should be placed on the agenda of the 91st Session (2003) of the Conference:
(a) Human resources training and development – Revision of the Human Resources Development Recommendation, 1975 (No. 150) (standard setting, first discussion);
(b) The employment relationship (scope) (general discussion);
(c) ILO standards-related activities in the area of occupational safety and health: An in-depth study for discussion with a view to the adoption of a plan of action for such activities (general discussion).

4. The Governing Body noted that, as a result of the above decisions, and having regard to the standing items that would necessarily be before the Conference, the agenda of the 91st Session (2003) of the Conference would be as follows:
I. Reports of the Chairperson of the Governing Body and the Director-General.
II. Programme and Budget proposals for 2004-05 and other financial questions.
III. Information and reports on the application of Conventions and Recommendations.
IV. Human resources training and development – Revision of the Human Resources Development Recommendation, 1975 (No. 150) (standard setting, first discussion);
V. The employment relationship (scope) (general discussion);
VI. ILO standards-related activities in the area of occupational safety and heath: An in-depth study for discussion with a view to the adoption of a plan of action for such activities (general discussion).

Third item on the agenda
5. The Governing Body took note of an oral report by the Chairperson on the discussion in the committee of the whole on the Office compilation and the Introduction by the Expert-Advisers. It endorsed the recommendations in paragraphs 30 to 33 of the Introduction, and accordingly decided:
(a) to approve the revised report form with regard to child labour, for use by the Office beginning with the 2001 reporting cycle;
(b) during its review of the reports compiled by the Office, to engage in a more in-depth discussion of certain aspects of the Introduction, intended in particular to:
(i) initiate a dialogue with the 18 governments that have not yet provided any reports owed under the Declaration follow-up (Afghanistan, Antigua and Barbuda, Armenia, Bosnia and Herzegovina, Equatorial Guinea, Fiji, Kazakhstan, Kiribati, Lao People’s Democratic Republic, Mongolia, Saint Lucia, Saint Vincent and the Grenadines, Sao Tome and Principe, Sierra Leone, Solomon Islands, Swaziland, The former Yugoslav Republic of Macedonia, Uzbekistan);
(ii) request further information from the Governments of Bahrain, Oman, Qatar, Saudi Arabia and the United Arab Emirates in relation to efforts made to promote the principle of freedom of association and effective recognition of the right to collective bargaining; and
(iii) request further information from the Government of China in relation to efforts made to promote the principle of the elimination of all forms of forced or compulsory labour;
(c) to extend by one day the meeting of Expert-Advisers to enable them to examine thoroughly the volume of information involved.
6. The Governing Body requested the International Labour Office to:
(a) give priority to countries that have not yet engaged in the process of their obligation under article 19(5)(e) of the ILO Constitution to report under the Declaration follow-up;
(b) offer to all countries that have encountered problems in the realization of the fundamental principles and rights at work, assistance in overcoming the problems, including the countries referred to in paragraph 30(b)(ii) and (iii);
(c) effectively mainstream the fundamental principles and rights at work into all relevant facets of its work;
(d) send the revised report forms as quickly as possible to all member States which owe reports under the Declaration follow-up, with a request that all provide full reports;
(e) make particular efforts to supply information on the effective abolition of child labour (including the worst forms of child labour) and on the elimination of discrimination in employment and occupation, in view of upcoming global reports on these subjects;
(f) assist those countries as well as others that request assistance so that they can provide a good baseline of information on which the country can build;
(g) continue to mobilize internal and extra-budgetary resources to meet countries’ needs in relation to the realization of the fundamental principles and rights at work;
(h) use innovative approaches to respond to as many requests as possible for technical cooperation that is aimed at ensuring respect, promotion and realization of the fundamental principles and rights at work;
(i) continue to strengthen links with intergovernmental organizations and development institutions at the regional and international level and encourage coordinated efforts in this direction by bilateral and multilateral actors, with the goal of promoting respect for the principles and rights in the Declaration;
(j) redouble its efforts to raise awareness about the Declaration in all countries among a variety of target audiences and to undertake advocacy to popularize the Declaration;
(k) enhance its own research efforts and encourage other researchers to examine more closely the linkages among the four categories of fundamental principles and rights at work as well as between them and broader development issues;
(l) disseminate information on the lessons that can be drawn from regional integration groups that are making strides in promoting fundamental principles and rights at work.
7. The Governing Body called upon governments to:
(a) meet their constitutional obligations in relation to reporting under the Declaration follow-up, where they have not yet ratified all the fundamental ILO Conventions;
(b) use the reporting process as a means of promoting social dialogue, in particular by involving the social partners in preparing their reports under the follow-up;
(c) use the revised report forms to provide a fuller picture of the baseline from which each reporting country is moving forward;
(d) improve their statistical baselines where they can be useful in promoting respect for the fundamental principles and rights at work;
(e) undertake studies and surveys to gain a clearer picture of the situation in their countries regarding respect for fundamental principles and rights at work, especially as regards the hidden sectors of the economy and phenomena that are increasing in importance, such as trafficking that involves forced labour;
(f) provide information and work closely with the ILO in overcoming barriers to the promotional follow-up under the Declaration, which is distinct from the supervisory mechanisms;
(g) work in close collaboration with the ILO to promote the Declaration by various means, including promotional initiatives undertaken with the social partners and, in the case of donor countries, the provision of support for technical cooperation designed to promote respect for the fundamental principles and rights at work.
8. The Governing Body called upon employers’ and workers’ organizations at the national, regional and international levels to participate more actively in the follow-up and to use the Declaration and its follow-up in line with a promotional spirit. (Sixth sitting; GB.280/3/1, paras.30-33)

Report and

European Regional Meeting
(Geneva, 12-15 December 2000)
10. The Governing Body requested the Director-General:
(a) to draw the attention of the governments of member States of the European region and, through them, that of their national employers’ and workers’ organizations, to the conclusions adopted by the Meeting;
(b) to bear the conclusions in mind in executing ongoing programmes and in preparing future programme and budget proposals;
(c) to transmit the text of the conclusions:
(i) to the governments of all member States, and through them, to national employers’ and workers’ organizations;
(ii) to the international organizations concerned, including the non-governmental international organizations having consultative status.

Report
of the 29th Session of the Joint
Maritime Commission
(Geneva, 22-26 January 2001)
11. The Governing Body:
(a) took note of the report of the Commission and in particular approved the recommendations contained in paragraphs 44, 45 and 46 of that report;
(b) requested the Director-General to communicate the report and resolutions to member States, international organizations of employers and workers, as well as other relevant international organizations.

12. The Governing Body decided to:
(a) establish a high-level tripartite working group in accordance with paragraph 7 of document GB.280/5, with a composition of 12 Government representatives, 12 Shipowners’ representatives and 12 Seafarers’ representatives and of Government, Employers’ and Workers’ observers with the right to speak and participate in the meetings of the working group taking due account of the criteria set out in paragraph 7 (c) of document GB.280/5 stressing that representatives and observers should be knowledgeable and active in the enforcement of the standards to be adopted and be able to commit the necessary time to lend to the continuity of the process;
(b) approve the recommendation that the decisions of the high-level tripartite working group should be taken by consensus;
(c) approve the setting up of a tripartite subgroup in accordance with the modalities set out in paragraph 7 of document GB.280/5;
(d) invite the Director-General to take note of the requests contained in paragraphs 7 and 8 of document GB.280/5 when establishing the programme of work of the Office for the rest of this biennium as well as for the 2002-03 and 2004-05 biennia.

13. The Governing Body:
(a) endorsed the proposals of the Commission as regards the updating of the minimum wage figure for able seamen contained in paragraph 12 of document GB.280/5;
(b) endorsed the proposal of the Commission as regards the future updating of this figure contained in paragraphs 11 and 13 of document GB.280/5;
(c) agreed to the establishment of a subcommittee of the Commission, at no cost to the Office, with terms of reference as set out in paragraph 14 of document GB.280/5.

14. The Governing Body requested the Director-General to convene, at no cost to the Office, a meeting of a joint working group as suggested in paragraph 16 of document GB.280/5. (First sitting; GB.280/5, para. 17)
15. The Governing Body invited the Director-General, when establishing the future programme of work of the Office, to take into account the request to convene a further meeting of the Commission and/or to hold a special meeting of experts to consider the results of the questionnaire on international registers. 16. The Governing Body:
(a) requested the Director-General to communicate the resolution concerning the structural changes within the industry to member States, drawing their attention to the Employment of Seafarers (Technical Developments) Recommendation, 1970 (No.139);
(b) instructed the Director-General to take the request in paragraph 21 of document GB.280/5 into account in the work programme of the Office.

17. The Governing Body invited the Director-General to:
(a) implement the measures requested in paragraph 23 of document GB.280/5;
(b) communicate the resolution concerning sub-standard shipping to member States, international organizations of employers and workers as well as other relevant international organizations.

18. The Governing Body invited the Director-General to take into consideration the request of the Commission mentioned in paragraph 25 of document GB.280/5. (First sitting; GB.280/5, para. 26)
19. The Governing Body requested the Director-General to:
(a) communicate the resolution concerning the human element to the Secretary-General of the International Maritime Organization;
(b) consult with the Secretary-General of the IMO on the possible setting up of a joint working party on the human element in international shipping.

20. The Governing Body:
(a) requested the Director-General to take note of the need for further sessions of the Joint Maritime Commission in the light of developments in the shipping industry when elaborating future programme and budgets;
(b) reiterated its support for the Commission as the body capable of advising member governments and the ILO on all aspects of the Organization’s work within the shipping industry and, in particular, the decent work programme.

21. The Governing Body invited the Director-General to:
(a) bring the issues referred to in paragraph 34 of document GB.280/5 to the attention of the preparatory meetings to be convened for the revision of the ILO’s maritime instruments;
(b) communicate the resolution concerning tonnage measurements and the accommodation of crews to the Secretary-General of the IMO.

22. The Governing Body requested the Director-General to:
(a) communicate the resolution concerning women seafarers to member States, international organizations of employers and workers and any other relevant institutions;
(b) take the request concerning the study on women seafarers, maternity and employment rights, referred to in paragraph 36 of document GB.280/5, into account in the Office’s work programme.

23. The Governing Body invited the Director-General to:
(a) communicate the resolution concerning seafarers’ welfare to the member States of the ILO, international organizations of employers and workers and relevant international organizations;
(b) take the resolution into account in the Office’s work programme for the promotion of decent work in the maritime industry.

24. The Governing Body requested the Director-General to communicate the resolution concerning action taken against seafarers in the event of maritime accidents to member States and relevant international organizations.

25. The Governing Body took note of the report and addenda 1 and 2. The Governing Body requested the Director-General to transmit to the Conference Committee on the Application of Standards the report together with the record of its consideration, as well as any further information of relevance for its discussion. 26. The Governing Body:
(a) recommended to the Conference that it hold a special sitting for the consideration of the Director-General’s report on the situation of workers of the occupied Arab territories during its 89th Session (2001);
(b) invited the Director-General to submit to the Selection Committee proposals relating to the holding of a special sitting at the 89th Session (June 2001) of the International Labour Conference for the consideration of his report on the situation of workers of the occupied Arab territories, based on arrangements approved at the 87th Session (June 1999) of the Conference, subject to the conditions mentioned in paragraph 4 of document GB.280/7.

41. The Governing Body decided, after approving the recommendations of the Joint Maritime Commission, that:
(a) the cost of the meetings in 2000-01, estimated at some $196,000, would be financed in the first instance from savings in Part I of the budget on the understanding that, should it subsequently prove impossible, the Director-General would propose alternative methods of financing at a later stage in the biennium; and
(b) a decision on the financing of the meetings in 2002-03 would be deferred until a later session of the Governing Body.

42. The Governing Body decided that, should it decide to appoint tripartite delegations to attend the World Conference against Racism, Racial Discrimination, Xenophobia and Related Intolerance to be held in Durban, South Africa, from 31 August to 7 September 2001, and the Third United Nations Conference on the Least Developed Countries to be held in Brussels, Belgium, from 14 to 20 May 2001, the maximum cost, estimated at $38,000, would be financed in the first instance from savings in Part I of the budget on the understanding that, should it subsequently prove impossible, the Director-General would propose alternative methods of financing at a later stage in the biennium. 44. The Governing Body:
(a) noted the status of implementation of the human resources strategy;
(b) noted the Collective Agreement on Arrangements for the Establishment of a Baseline Classification and Grading (GB.280/PFA/11, Appendix I) and approved, on an exceptional one time basis, any necessary derogation from article 4.2(f) of the Staff Regulations solely for the purpose of meeting the Office’s commitment referred to in paragraph 5 of the abovementioned document and on the understanding that the baseline grading exercise will be completed by November 2001, and requested the Office to provide an evaluation report on the exercise at the 283rd Session (March 2002) of the Governing Body;
(c) noted the Collective Agreement on Prevention and Resolution of Harassment-related Grievances (GB.280/PFA/11, Appendix II) and requested the Office to provide the associated Staff Regulations to the Governing Body for its approval in November2001, noting that these Regulations will be reviewed at the Governing Body session in March 2003;
(d) approved the proposal outlined in document GB.280/PFA/11 Appendix III to introduce the National Professional Officer category of staff and requested the Office to amend the Staff Regulations to include this new staff category within their scope;
(e) requested the Office to:
(i) submit a revised proposal for a paternity leave benefit, together with proposed amendments to the Staff Regulations, for consideration at the 282nd Session of the Governing Body in November 2001;
(ii) submit to the 282nd Session of the Governing Body in November 2001 an implementation and impact analysis of the paternity leave proposal;
(iii) notify the ICSC of the ILO proposal and request it to respond, before November 2001, if it sees any conflict between the paternity leave proposal and the common system;
(iv) submit to the Governing Body for approval at its 282nd Session the Staff Regulations which would authorize the Office to take action to implement family support obligations through salary deductions where an official does not honour a relevant court order;
(f) reaffirmed the primacy of the UN common system with respect to the establishment of terms and conditions of employment for ILO officials;
(g) reaffirmed the Staff Regulations as the legal basis for the establishment of conditions of employment of ILO officials.

49. The Governing Body decided to submit to the International Labour Conference, for adoption at its 89th Session (June 2001), the following resolution:
The General Conference of the International Labour Organization,
Decides, in accordance with Article III of the Statute of the Administrative Tribunal of the International Labour Organization, to renew the appointment of Mr. Michel Gentot (France) and that of Mr. Jean-François Egli (Switzerland) for a term of three years.

51. Subject to the positions taken, and to the reservations expressed during the discussion, the Governing Body decided:
(a) to propose to the International Labour Conference at its 89th Session (June 2001) a provisional programme level of $472,488,505, estimated at the 2000-01 budget exchange rate of 1.53 Swiss francs to the US dollar, the final exchange rate and the corresponding US dollar level of the budget and Swiss franc assessment to be determined by the Conference;
(b) to propose to the Conference at the same session a resolution for the adoption of the Programme and Budget for the 68th financial period (2002-03) and for the allocation of expenses among member States in that period in the following terms:
The General Conference of the International Labour Organization,
In virtue of the Financial Regulations, adopts for the 68th financial period, ending 31 December 2003, the budget of expenditure for the International Labour Organization amounting to $ ............ and the budget of income amounting to $ .........., which, at the budget rate of exchange of ....... Swiss francs to the US dollar, amounts to .......... Swiss francs, and resolves that the budget of income, denominated in Swiss francs, shall be allocated among member States in accordance with the scale of contributions recommended by the Finance Committee of Government Representatives.

52. The Governing Body, in accordance with the established practice of harmonizing the rates of assessment of ILO member States with the rates of assessment in the United Nations, decided to propose to the Conference that the contribution of the Federal Republic of Yugoslavia to the ILO budget for the period of its membership in the Organization in 2000 and 2001 be based on annual assessment rates of 0.026 per cent and 0.020 per cent respectively. 53. The Governing Body, in accordance with the established practice of harmonizing the rates of assessment of ILO member States with their rates of assessment in the United Nations, decided to propose to the Conference the adoption of the draft scales of assessments for 2002 and 2003 as set out in column 3 of Appendices A and B respectively of document GB.280/11/4, subject to such adjustments as might be necessary following any further change in the membership of the Organization before the Conference was called upon to adopt the recommended scales. 54. The Governing Body authorized the Government members to continue their work, if necessary, after the Governing Body had concluded its work at this 280th Session and to submit their report direct to the Finance Committee of Government Representatives at the Conference. 55. The Governing Body decided that the costs of the Tripartite Forum on Promoting the Tripartite Declaration of Principles concerning Multinational Enterprises and Social Policy in 2002, estimated at US$112,000, would be financed from the Technical Meetings Reserve Fund in the draft Programme and Budget for 2002-03. 56. The Governing Body invited the Office to prepare a new paper for the November 2001 Session, which takes into account the observations communicated by the members of the Committee. (Seventh sitting; GB.280/12/1, para. 9)
57. The Governing Body:
(a) approved the revised report form regarding the effective abolition of child labour, appearing in Appendix I of document GB.280/12/1, for use by the Office as from April 2001 in the annual review under the follow-up to the ILO Declaration on Fundamental Principles and Rights at Work;
(b) deferred a decision regarding proposed revised report forms relating to the other three categories of fundamental principles and rights at work covered by the follow-up to the Declaration until a later session of the Committee.

58. The Governing Body invited the Director-General to:
(a) prepare, in the light of the views expressed during the discussions, and in consultation with the constituents, proposals for the 282nd Session (November 2001) of the Governing Body on possible modifications in the reporting modalities;
(b) prepare documentation which would enable the Working Party on Policy regarding the Revision of Standards to examine the question of groups of instruments at its next session in November 2001;
(c) inform the supervisory bodies of any relevant comments that might facilitate the review of their working methods and any proposals they themselves might wish to make;
(d) undertake consultations for the preparation of an overview of the special procedures for an initial discussion at the 283rd Session (March 2002) of the Governing Body;
(e) specify other questions, such as promotional activities, which should be the object of an in-depth review at the subsequent stage;
(f) take the necessary measures for increasing knowledge of the system, including training for those directly involved in its functioning, and, at the appropriate time, the revision of the Handbook of procedures relating to international labour Conventions and Recommendations with the aim of making it more user-friendly.

59. The Governing Body:
(a) took note of the report of the Working Party on Policy regarding the Revision of Standards (GB.280/12/2, Appendix I), and of the opinions expressed during the meeting of the Committee;
(b) approved the recommendations contained in the corresponding paragraphs of the report on which there was a consensus in the Working Party and the Committee.

Report of the Joint ILO/UNESCO Committee of
Experts on the Application of the Recommendation
concerning the Status of
Teachers

63. The Governing Body decided:
(a) to take note of the report of the Seventh Session of the Joint ILO/UNESCO Committee of Experts on the Application of the Recommendation concerning the Status of Teachers;
(b) to authorize the Director-General to communicate the report to the governments of member States, and through them to the employers’ and workers’ organizations concerned, as well as to concerned intergovernmental and non-governmental organizations, and to invite them to continue and to intensify their efforts to apply all provisions of the ILO/UNESCO Recommendation, 1966, and the UNESCO Recommendation, 1997, in light of the Joint Committee’s analysis and recommendations to improve teachers’ status;
(c) to authorize the Director-General to communicate the relevant part of the annex containing the Joint Committee’s examination of the allegations before it to the Governments of Albania, Bolivia, Burundi, Czech Republic, Ethiopia, Japan, Senegal and the Federal Republic of Yugoslavia, to the relevant United Nations bodies and to the teachers’ organizations concerned, and where appropriate, to invite them to take the necessary follow-up action as recommended in the report;
(d) to forward the report to the International Labour Conference at its 89th Session (June 2001) for examination in the first instance by the Committee on the Application of Standards;
(e) to approve the change of the official title of the Joint Committee to “Joint ILO/UNESCO Committee of Experts on the Application of the Recommendations concerning Teaching Personnel”.

(c) invited the Director-General to distribute, as broadly as possible, the results of the Seventh Survey in line with the views expressed by the Subcommittee in its discussion of this item as reflected in the report of the Subcommittee to the Governing Body and decided that the full summary of the reports submitted by governments and by employers’ and workers’ organizations for the Seventh Survey, would be supplied on request.
