Annex 2 to
The Recognition and Procedural Agreement

between
the International Labour Office
and the ILO Staff Union

 

Preamble


NOTING the Recognition and Procedural Agreement between the International Labour Office and the ILO Staff Union, signed on 27 March 2000 (hereinafter "the principal Agreement"),

RECALLING that the Review Panel, in accordance with Article 7 paragraph 2 of the principal Agreement, has not been constituted within two months of the date of the principal Agreement,

CONSIDERING NEVERTHELESS that it is highly desirable that such Review Panel should be constituted as soon as possible,

The Parties to the principal Agreement agree as follows:

Article 1

The time within which the Review Panel may be constituted for the first time is extended until 31October 2000, on the understanding that both Parties shall nominate one member of the Review Panel at an early date.

Article 2

Each Party shall notify the Joint Negotiating Committee of the name of the person it nominates as its appointee to the Review Panel. The Parties shall confirm such nominations, as well as the joint appointment of the Chair, by the joint signature of letters to the persons concerned.

Article 3

In accordance with Article 7, paragraph 2, of the principal Agreement, the initial mandate of the members of the Review Panel shall be for a period of two years. Subsequent appointments to the Review Panel, on nomination by the appropriate Party or on joint appointment as the case may be, shall take effect upon the expiry of a mandate and shall similarly be for two years.

Article 4

The members of the Review Panel shall act in an independent and impartial manner. Members of the Review Panel who are ILO officials shall agree to tend their resignation when a substantial change in duties and responsibilities could impinge on their ability to act in the capacity they were nominated for. Once appointed, members of the Review Panel may be removed only on their own request addressed to the Chair of the Review Panel or, in the case of the Chairperson, simultaneously to both Parties.


Article 5

Participation in the work of the Review Panel shall, in the case of an ILO staff member, be considered as part of official duties. Immediately upon constitution of the first Review Panel, the chairperson shall be released from his/her other ILO duties for a period of one month for the purposes of drawing up draft rules, for adoption by the Review Panel and laying the administrative groundwork for its functioning in line with Article 7 paragraph 3 of the principal Agreement. Members of the Review Panel who are ILO officials shall be released from their other ILO duties to the extent they consider this to be necessary to carry out their mandate under Article 7.

Article 6

The Office agrees to meet all reasonable costs associated with the operation of the Review Panel.

Article 7

In accordance with Article 7, paragraph 3, of the principal Agreement, the Parties may refer a matter to the Review Panel either separately or jointly. The period of 15 working days within which the Review Panel shall conclude the review process (unless the Parties agree on extension of that period) shall start from the date on which a matter has been referred to the Review Panel.
