Consolidating the Legal and Institutional Foundations of Social Dialogue in the Countries of Western Balkans and Moldova 2008-2010


Countries covered: Albania, Bosnia and Herzegovina, FYR Macedonia, Moldova, Montenegro, Serbia, Kosovo1

The main goal of the project is to contribute to the strengthening of economic and social governance in the Western Balkan countries and Moldova. The focus of the project is to consolidate the institutional and legal foundations of social dialogue and to promote an effective culture of social dialogue. The project has identified two problems which it proposes to address, namely:
a) not efficient tripartite social dialogue; and
b) not efficient bipartite social dialogue.

The project addresses the first problem through activities aimed at:
- strengthening the role and functioning of Economic and Social Councils and similar tripartite institutions; and
- enhancing the capacities of tripartite actors in relation to social dialogue.

It seeks to address the second problem through:
- advocacy and technical advice to create alternative systems for the peaceful settlement of labour disputes; and
- enhancement of the skills of workers and employers in negotiating techniques and procedures and the improvement of their organisational capacities.

The project’s strategy to address these two main problems is based on the combination of a set of national and subregional activities linking capacity building, advocacy, and technical and legal advice to accompanying measures to be taken by tripartite constituents themselves in the target countries.

It will also pay special attention to two principal and fundamental rights at work, namely freedom of association and gender equality. Concerning freedom of association, the project will assist in removing existing legal and institutional obstacles in some target countries, which prevent employers’ organisations and trade unions from operating freely and independently. As far as gender equality is concerned, the project will focus on two aspects, namely a) enhancing gender balanced representation in social partner organisations and social dialogue institutions and b) addressing gender equality issues through social dialogue and collective bargaining.

The project will take into consideration other players’ interventions in the region in the field of social dialogue as well as gender equality, and seek synergies with them.

Bulgaria: helping businesses to enter the formal economy
GENEVA (ILO Online) - In 2003, a new regulation was introduced in Bulgaria, whereby it became compulsory for employers to register all labour contracts. In addition, as many employers and enterprises are unaware about the new regulations, there is a strong need now to inform them on how to conform with the new system. The ILO's Bureau for Employers' Activities (ACT/EMP) supports the Bulgarian Industrial Association (BIA) - the largest Bulgarian employers' organization, to help companies moving from informality to formality. ILO on line spoke with Henrik Moller and Jean-Marie Standaert, both from ACT/EMP, who assist BIA in making this happen.
