The article 5 of the Royal Law 36/1978 created the National Institute of Employment in November 16th of 1978. It is an autonomous administrative agency ascribed to the Ministry of Labour and Social Security. The Institute responds directly to the Ministry.

The following units are part of the National Employment Institute: the Employment and Training Action Service, Worker Vocational Promotion and the Vocational Training Unit of Institutional Administration of the Socio-Vocational Services.

The National Employment Institute has, as a management agency of the employment policy, the following functions:

To organize the services of employment in order to achieve public and free development and use of resources.
To help workers to find jobs and enterprises to hire the adequate workers.
To promote workers training in close relation to the policies of employment through actions of updating, further training and retraining.
To manage and control the unemployment benefits and the unemployment subsidies and aids.
To declare the recognition, extinction and renewal of the unemployment benefits.
To manage the services derived from the unemployment benefits.
To declare the recognition, extinction and renewal of the unemployment benefits.
To demand devolution of workers benefits if wrongly perceived and reimbursement when entrepreneurs are responsible.
To coordinate services with the Social Security General Office of Treasurer or any other Public Administration.
To participate, in general, in all actions that lead to an active policy oriented to full employment.
