What does the legal advice comprise?

The legal advice activities comprise:

  • Drafting of national social security legislation;
  • Revision of national social security legislation;
  • Commenting on draft social security legislation;
  • Providing assistance to Member States to ensure the compliance of national legislation and practice with the relevant ILO social security Conventions; and
  • Assisting Member States in establishing effective social security protection for migrant workers, which includes the drafting of bilateral and multilateral social security agreements.

In close collaboration with the International Labour Standards Department, the Social Security Department carries out the following activities:

  • Providing assistance to Member States in the assessment of the compliance of their national legislation and practice with the relevant social security Conventions;
  • Providing assistance to Member States engaging in the process of ratification of ILO social security conventions;
  • Providing assistance to Member States in fulfilling the legal obligations arising out of the ratification of social security Conventions, and
  • Providing assistance to Member States in fulfilling their reporting obligations regarding legal and statistical requirements arising out of the ratification of social security Conventions.

Key activities recently carried out in this regard comprise:

  • The drafting of the Unemployment Insurance Law for Bahrain;
  • Assisting the Governments of Lithuania, Moldova and Romania in the assessment of the compliance of their national legislation and practice with Convention No. 102; and
  • Assisting the Government of Albania and the Government of Jordan in the process of ratification of Convention No. 102.

The application and implementation of ILO social security standards by Member States is guaranteed by the activity of the ILO's supervisory bodies, the Committee of Experts on the Application of Conventions and Recommendations and the Conference Committee on the Application of Standards.
