the studies must be organised, subsidised or recognised by a Community and
be either at a level equivalent or higher than the already completed
studies, or at a level lower than the already completed studies provided
that they consist of higher education;
the courses may not take place mainly on Saturdays or after 5 pm;
the unemployed person cannot be registered as a free student and he or she
has had to follow the activities imposed by the program of studies;
the unemployed person must have finished his or her studies or training
within 2 years;
the unemployed person must have been registered as completely unemployed
during two years preceding the beginning of the studies;
the unemployed person may not possess a diploma of higher education
(except if this diploma offers only few prospects on the labour market).
The unemployed person must only be entitled to the benefits of a completely
unemployed person at the beginning of the studies for which the exemption is
required provided these studies prepare for professions in which there is a
significant shortage of labour. The list of these professions has been drawn up
by the ONEM on the basis of objective information gathered from studies of the
labour market conducted by the regional placement organizations.
