UN Instruments - Appropriate Measures to Allow Women Workers with Family Responsibilities to Conciliate these Responsibilities and Their Professional Obligations

Universal Declaration of Human Rights - article 16.3:

Article 16

  1. The family is the natural and fundamental group unit of society and is entitled to protection by society and the State.

International Covenant on Economic, Social and Cultural Rights - article 10.1:

Article 10

The States Parties to the present Covenant recognize that:

  1. The widest possible protection and assistance should be accorded to the family, which is the natural and fundamental group unit of society, particularly for its establishment and while it is responsible for the care and education of dependent children. Marriage must be entered into with the free consent of the intending spouses. 

International Covenant on Civil and Political Rights - article 23.1:

Article 23

  1. The family is the natural and fundamental group unit of society and is entitled to protection by society and the State.

Convention on the Elimination of All Forms of Discrimination against Women - articles 10(h)and 11.2(c):

Article 10

States Parties shall take all appropriate measures to eliminate discrimination against women in order to ensure to them equal rights with men in the field of education and in particular to ensure, on a basis of equality of men and women:

  1. Access to specific educational information to help to ensure the health and well-being of families, including information and advice on family planning. 

Article 11

  1. In order to prevent discrimination against women on the grounds of marriage or maternity and to ensure their effective right to work, States Parties shall take appropriate measures:

    1. To encourage the provision of the necessary supporting social services to enable parents to combine family obligations with work responsibilities and participation in public life, in particular through promoting the establishment and development of a network of child-care facilities.

Beijing Platform for Action, paragraph 179 (c), 180 (a):

Paragraph 179

  1. Governments are called to, ensure through legislation, incentives and/or encouragement, opportunities for women and men to take job-protected parental leave and to have parental benefits; promote the equal sharing of responsibilities for the family by men and women, including through appropriate legislation, incentives and / or encouragement, and also promote the facilitation of breast-feeding for working mothers.

Paragraph 180:

  1. Governments, the private sector and non-governmental organizations, trade unions and the United Nations are called to adopt appropriate measures involving relevant governmental bodies and employers’ and employees’ associations so that women and men are able to take temporary leave from employment, have transferable employment and retirement benefits and make arrangements to modify work hours without sacrificing their prospects for development and advancement at work and in their careers.

Convention on the Rights of the Child - article 18.3:

Article 18

  1. States Parties shall take all appropriate measures to ensure that children of working parents have the right to benefit from child-care services and facilities for which they are eligible.
