Constitution - Senegal

Relevant provisions may be summarised as follows:

a. Article 1 ensures equality of all citizens before the law.

b. Under article 3, all nationals of both sexes enjoying their political and civil rights and who are more than 18 years have the right to vote.

c. Article 4 provides that all human beings are equal before the law. Men and women have the same rights.

d. Article 15 provides that men and women have equally the right to access to ownership and to land property under the conditions set out by law.

e. Article 17 provides that marriage and family constitute the natural and moral foundation of human community. They are placed under the protection of the State. Under the same article the State guarantees to families in general and particularly to those in rural areas access to health services and well-being. It also guarantees to women, particularly rural women, improvement of their living conditions.

f. Under aarticle 19, the wife enjoys the right to have their own patrimony like her husband. She has the right to personally manage her property.

g. Under aarticle 22, all children, boys and girls, in all areas of the national territory have the right to access to education.

h. Article 25 provides that everyone enjoys the right to work and to seek employment. Nobody shall be prejudiced in his work because of origin, sex, opinion, political choice or belief. All discrimination between men and women in employment, pay, or taxes is forbidden.

i. Article 95 provides that the President of the Republic is entitled with the treaty-negotiating power. He ratifies or approves them under the authorization of the Parliament. Under article 96, peace treaties, or treaties and agreements related to an international organisation, or those which engage the State’s finance, those which modify legislative provisions, those concerning the status of individuals, or territory cession or addition, can be ratified or approved only by virtue of a law. Article 97 provides that if the Constitutional Court declares that where an international commitment embodies a provision which is contrary to Constitution, the authorization of its approval or ratification can occur only after the constitution has been revised. Under article 98, international treaties and agreements which are legitimately ratified or approved are, as of their publication, superior to the laws, subject to their implementation by the other party.
