2002-2003 Collective Agreement - Romania

Article 2 provides that employers shall abstain from any form of discrimination upon hiring and establishing employee’s rights.

Article 17(1) states that employees who relinquish the parental leave granted to take care of children less than 2 years old shall benefit from a 2 hours per day cut in their working time. This cut shall not affect their remuneration. According to Article 17(2), women raising children less than 6 years old are entitled to work half-time, if they cannot benefit from a nursery. This shall not affect the rights flowing from the employee’s status. Article 17(3) provides that, at the pregnant employee’s request, the employer shall allow for medical examinations during the working time in conformity with the doctor’s recommendations. Article 62 further provides that, in addition to the parental leave granted until the children is 2 years old, mothers are entitled to a one year of unpaid leave.

Women in their fifth month of pregnancy, as well as breast-feeding women, must not perform night work, overtime work, or be sent on business trips without their consent (Article 33(2). Article 33(4) further stresses that other specific rights can be established through collective agreements concluded at other levels.

Article 36 deals with the Committees on Work Security and Health. It notably establishes that, in undertakings where more than 50 employees work, and women represent at least 20% of the workforce, at least one woman will sit on the Committee.
