The Constitution of the Republic of Poland, amended in 1997,
guarantees the equal rights of men and women through provisions concerning the
protection of the mother and child, protection of pregnant women, paid leave in
the period before and after confinement, and the development of maternity
clinics, nurseries and kindergardens.
Article 32 entrenches the right of all persons to equality and
to non-discrimination. Article 33 specifically guarantees equality between men
and women:
33(1). Men and women shall have equal rights in family,
political, social and economic life in the Republic of Poland.
(2). Men and women shall have equal rights, in particular,
regarding education, employment and promotion, and shall have the right to
equal compensation for work of similar value, to social security, to hold
offices, and to receive public honours and decorations.
The Constitution also guarantees the principles of equal pay for
equal work and the protection of the mother:
78(1). Women in the Republic of Poland shall have equal
rights with men in all fields of public, political, economic, social and
cultural life.
(2) The equality of rights of women shall be guaranteed by:
-
equal rights with men to work and to be paid according
to the principle "equal pay for equal work", the right to rest
and leisure, to social insurance, to education, to honours and
decorations, and to hold public offices;
-
mother-and-child care, protection of expectant mothers,
paid leave before and after confinement, the development of a network of
maternity clinics, creches and nursery schools, the extension of a network
of service establishment and canteens.
(3) The Republic of Poland shall strengthen the position of
women in society, especially of gainfully employed mothers and women.
