Constitution
- Nepal
The Constitution of the Kingdom of Nepal (1990) establishes a constitutional
monarchy based on a multi-party democracy. It also contains some provisions
related to equality and women:
- Article 11 ensures the right of equal pay for the same work. It provides
for equality of all citizens before the law without any discrimination
on the grounds, of sex, race, religion, ideology, tribe or caste. It
states that no discrimination should be made in the application of laws
or by the State, on the grounds of, inter alia, sex.
- Article 20 guarantees the right to be free of exploitation in the
form of slavery and forced labour. Traffic in human beings, slavery,
serfdom or forced labour in any form is prohibited, except for compulsory
services employment.
- Article 26 (9) mentions that the State shall pursue such policies
in matters of education, health and social security of orphans, helpless
women, the aged, the disabled and incapacitated persons, as well as
ensure their protection and welfare.
- According to article 114, for the purposes of elections to the House
of Representatives, at least five percent of the total number of candidates
contesting an election from any organization or party must be women.
