Constitution
- Hungary
Under art. 77, the Constitution is the supreme law of the
Republic of Hungary and the Constitution and laws and statutes established in
accordance with it are equally binding for all social organizations, government
bodies and citizens of the country. A number of provisions of the Constitution
are relevant to women and employment:

Article 7 provides that the legal system accepts the
generally recognized principles of international law and requires
harmonisation of domestic law with international law obligations.

Article 56 provides that everyone is legally capable.

Article 57 provides for equality before the law. It should
be noted that under article 8(4), this right falls within the class of
rights that can not be suspended or restricted during a national emergency.

Article 66 requires the Republic of Hungary to ensure the
equality of men and women in all civil, political, economic, social and
cultural rights. Mothers must receive support and protection, before and
after the birth of the child, in accordance with separate regulations which
must also ensure the protection of women in the workplace. It should be
noted that under art. 8(4), these rights fall within the class of rights
that can not suspended or restricted during a national emergency.

Article 70A requires the Republic of Hungary to respect the
human and civil rights of all persons in the country without discrimination
on the basis of, amongst other things, gender or on any other grounds
whatsoever. It also requires the law to provide for strict punishment of
discrimination and the Republic of Hungary to endeavour to implement equal
rights for everyone through measures that create fair opportunities for all.

Article 70B provides that everyone has the right to work and
to freely choose their job and profession and to equal compensation for
equal work, without any discrimination whatsoever. All persons who work have
the right to an income that corresponds to the amount and quality of work
they carry out.
