Constitution - Bulgaria

The Constitution of the Republic of Bulgaria, adopted on 12 July 1991, contains some provisions related to equal employment opportunity policies.

Under article 5, ratified and promulgated international instruments are considered to be part of the domestic legislation of Bulgaria, and override any conflicting domestic legislation. Thus, international instruments endow citizens with direct rights.

Article 6 provides that all persons are born free and equal in dignity and rights and that all citizens are equal before the law. No privileges or restriction of rights may be based on, inter alia, sex and personal or social status.

State and society must also protect the family, motherhood and childhood (article 14). In this regard, spouses have equal rights and obligations in matrimony and the family (article 46(2).). The upbringing of children until their majority is a right and an obligation of parents who must be assisted by the State (article 47(1).). Moreover, mothers are guaranteed prenatal and postnatal leave, free obstetric care, alleviated working conditions, and other social assistance (article 47(2).).

The following rights are also guaranteed for workers and employees; healthy and non-hazardous working conditions, minimum pay and remuneration for the actual work performed, and rest and leave in accordance with conditions and procedures established by law (article 48(5).).

Finally, everyone has the right to education (article 53(1).). The State must also provide opportunities for occupational training and retraining (article 53(6).).
