Equality of Opportunity in Education and Training - Equal Educational Opportunities Act - United States

Equal Educational Opportunities Act of 1974

In 20 USC §1701, the Congress states that all children enrolled in public schools are entitled to equal educational opportunity without regard to, inter alia, sex and that the neighbourhood is the appropriate basis for determining public school catchment areas. In order to do so, the Congress specifies appropriate remedies for the elimination of the vestiges of dual schools systems (20 USC §1702).

20 USC §1703  affirms that no State has the right to deny equal educational opportunity to an individual on account of his or her, inter alia, sex. However, the failure of an educational agency to attain a balance, on the basis of, inter alia, the sex of students among its schools does not constitute a denial of equal educational opportunity, or equal protection of the laws (20 USC §1704).
