Adoption of Convention No. 182 on the Prohibition and Elimination of the Worst Forms of Child Labour and Accompanying Recommendation No. 190


The ILO Convention No.182 and Recommendation No.190 were unanimously approved in the General Assembly of the June 1999 International Labour Conference. The objective of the new Convention and Recommendation is not to replace Convention No.138 and Recommendation No.146 which are still the fundamental child labour instruments. Rather, the purpose is to complement them by providing basic measures to secure the immediate suppression of all worst forms of child labour.

The new Convention defines for the first time what constitutes the "worst forms of child labour." It calls for international cooperation on social and economic development, poverty eradication and education to realize its terms, and provides for broad consultation among governments, workers and employers - the "social partners" in the ILO's tripartite structure.

The Convention requires ratifying States to "design and implement programmes of action" to eliminate the worst forms of child labour as a priority and "establish or designate appropriate mechanisms" for monitoring implementation of the Convention, in consultation with employers' and workers' organizations. It also says ratifying States should "provide support for the removal of children from the worst forms of child labour, and their rehabilitation; ensure access to free basic education or vocational training for all children removed from the worst forms of child labour; identify children at special risk; and take into account the special situation of girls." The accompanying Recommendation defines, among others, "hazardous work".

The ILO will launch a worldwide campaign for ratification - which is the process by which the Convention is translated into national law and practice. The trade unions can play an important role in the ILO's tripartite structure and be one of the most persuasive forces in the campaign for ratification. The trade unions must continue the fight for children's basic rights.
