Memorandum of Understanding between the International Labour Organisation
and the East African Community

 

The International Labour Organisation (hereinafter referred to as ILO) and the East African Community (hereinafter referred to as EAC)

DESIROUS of developing and strengthening their co-operation with respect to matters of common concern;

CONVINCED that the development and strengthening of such co-operation would be of mutual benefit to both Organisations and would enhance co-operation among their Member/Partner States;

HAVE AGREED AS FOLLOWS:

ARTICLE I
Consultation

The ILO and EAC agree that in order to facilitate the attainment of the objectives of the two Organisations, they shall consult each other in respect of planning and execution of programmes relating to matters of common concern and particularly those that fall within the EAC Labour and Employment Sector, namely:

(a) the pursuit of employment policies aimed at creating conducive environment for investment and development of the private sector, with a view to creating employment opportunities for poverty reduction through small enterprise development and the promotion of co-operative associations;

(b) employment-intensive technology transfer for infrastructural development and maintenance in rural and urban areas;

(c) strengthening of vocational training institutions/systems;

(d) the facilitation of labour mobility;

(e) harmonisation/approximation of labour legislation;

(f) the establishment of fair labour practices through social dialogue; for the promotion and realisation of the fundamental principles and rights at work;

(g) social security, including:

- extension of coverage for people and benefits
- development and improvement of schemes
- government and management, including training
- protection for migrant workers; and

(h) productivity improvement.

ARTICLE II
Exchange of Information

Subject to such arrangements as may be necessary to safeguard the status of confidential material available to them, ILO and EAC shall exchange information and documentation on matters of common concern, and will keep each other informed of current and planned activities of mutual interest for the purpose of identifying areas in which co-operation between them may prove desirable.

ARTICLE III
Joint Activities

ILO and EAC may, on conditions to be mutually agreed in each case, carry out joint studies or co-operate in the implementation of specific programmes or projects, relating to matters of common concern and those which fall within the mandate of the ILO.

ARTICLE IV
Attendance at Meetings

Each Organisation may, in accordance with its own constitutional provisions, invite the other to meetings that it has convened, when matters of concern to the other are to be discussed.

ARTICLE V
Provision of Expertise

Each Organisation may, on conditions to be mutually agreed in each case and within the limits of its resources, make available its experience and expertise to the other, by providing the services of members of its staff/or consultants as the case may be.

ARTICLE VI
Implementation

The Director, ILO Area Office, Dar es Salaam and the Secretary General of EAC shall be responsible for the implementation of this Memorandum of Understanding.

ARTICLE VII
Duration and Termination

This Memorandum of Understanding shall remain in force indefinitely and shall be terminated by mutual consent, or by one party giving the other party six(6) months written notice of its intention to terminate this Memorandum of Understanding.

ARTICLE VIII
Amendments

(a) The Parties hereto may enter into such supplementary arrangements or agreements within the scope of this Memorandum of Understanding as may be appropriate.

(b) This Memorandum of Understanding may be amended by mutual consent. Each Organisation may give a sympathetic consideration to any amendment proposed by the other party.

ARTICLE IX
Notice and Addresses

Any notice required to be given or made pursuant to this Memorandum of Understanding shall be in writing. Such notice shall be deemed to have been duly given or made when it shall have been delivered by hand, mail, fax, telex or telegram to the party to which it is required to be given or made, at the address specified herebelow:

ARTICLE X
Entry Into Force

This Memorandum of Understanding shall enter into force on the date of its signature by both parties.

Done at Arusha, Tanzania on Thursday, this l8th day of January 2001, two originals, in the English Language, both texts being equally authentic.
