Honduras - Working time - 2011

Duration

General

The period of time of annual leave differs in relation to the time of work performed with the same employer:
- 10 consecutive working days after one year of service.
- 12 consecutive working days after two year’s consecutive service;
- 15 consecutive working days after three year’s consecutive service;
- 20 consecutive working days after four or more year’s consecutive service.

Workers shall enjoy without interruption their holidays, but at the request of the employer, and when the urgent measure so requires, he can be request the worker to return to work without prejudice to return on vacation afterwards. In that case, the costs are assumed by the employer.

Duration

General

The duration of the annual leave shall be determined in accordance to the Schedule depending on the number of days worked in each qualifying year.

Workers who have worked up to 220 days enjoy 10 days maximum (if minimum worked 110 days) calculated as follows; 1/22 of the number of days of work. Any fraction of a day of holiday shall be reckoned as 1 day.

For workers who have worked more than 220 days: 2 working weeks.

For workers with 10 years of service or more and who have worked more than 220 days in each qualifying year: 3 working weeks.

Duration

General

The duration of the annual leave is set in 6 working days minimum, after one year of service with the same employer. This duration shall be increased by two working days (up to a maximum of 12) for each subsequent year of service. After the fourth year, the vacation period shall be increased by two days for every five years of service.

Workers who perform discontinuous and seasonal work are entitled to an annual holiday period in proportion to the number of the working days performed in the year.

The first day of December is a public holiday every six years, when the new Federal Executive takes office. The following nine days are public holidays where the workers are entitled to a paid rest day: 1 January, Maundy Thursday and Good Friday, 1 May, 19 July, 14 and 15 September, 8 and 25 December.

The Government may declare other days as public holidays to be enjoyed from this year onwards or only for the current year, like the "Domestic Worker Day" fixed on the December 10th each year, in which day, this category of workers shall enjoy the rest day with full pay, or the 8th of December 2011 to be enjoyed as national public holiday for all the workers in the private and public sector.

Workers shall be entitled to enjoy 30 days of annual leave.

When the wage of the worker is calculated as a result of variable incomes, the amount shall be calculated according to the average of the ordinary and extraordinary incomes over the last 11 months or the amount corresponding to the wage of the last month if more favourable.

The date of payment of the amount due to the annual leave period shall be paid with 3 days in advance of the date in which the leave commences.

Payment

It is unclear if public holidays are paid since there are no provisions in the legislation. However some sources determines that leave entitlements in the private sector are agreed between employers and unions, which became part of a registered collective agreement. In absence of such collective agreements paid public holidays are at the discretion of the employer.
