Duration

General

The legal duration of annual leave is set to 25 working days per year.

Supplementary leave of 6 days for workers with disabilities and for physically or mentally disabled persons.

For the first year the employee can claim 1/12 of the holidays for every month worked.

Amount

An employer must continue to pay the employee during the period of paid annual leave.

Leave allowance represents the employee’s average salary, including overtime and fringe benefits:
- during the 3 months prior to the leave;
- or the past 12 months for employees whose pay is subject to significant variations (salary paid as a percentage of sales, depending on turnover, etc.).

Non-regular payments (bonuses, performance-related bonuses, etc.) are not taken into account.

General

Every worker shall be entitled to paid annual leave of at least the equivalent in hours of four weeks and four working days calculated on the basis of a 40 hour working week and 8 hour working day.

General

All employees have the right to an annual paid holiday, with duration of not less than 28 calendar days without taking into account the non working holidays.

Employees of special sectors (education, health service, public service, etc.) can be granted annual leave of a different duration.

For the period of annual paid holiday, a holiday allowance is due to the employee, the size of which cannot be less than the wages, increases and, on occasion, the severance pay for the corresponding period.
Replacement of the unused annual paid holidays by monetary indemnification is not admitted, except for the cases of termination of the individual labour contract of the employee who was not using the holiday.

The annual leave shall have a minimum length of 20 working days.
The actual length of the annual leave shall be laid down in the applicable collective labour agreement, shall be provided for in the individual employment contract and shall be granted in proportion to the activity performed in a calendar year.

Amount

During the leave, the employee shall receive a leave benefit which may not be lower than the basic pay, the benefits and permanent extra pay due for that period, as provided for in the individual employment contract.

The leave benefit shall be the daily average of the pecuniary rights in the last three months before the month when the leave is taken,
multiplied by the number of days of leave.

The leave benefit shall be paid by the employer at least five working days before taking the leave.

Payment

Daily working time is to be reduced by one hour the day preceding a public holiday. If it is impossible to take leave due to continuous work, the employee shall be compensated with either additional leave, or by agreement, receive overtime payment.
