LEGAL DEFINITIONS


Employee/worker

"Worker" shall mean any natural person who has entered into an employment relationship on the basis of a concluded employment contract.

Employer

"Employer" shall mean a legal and natural person or another entity such as a state body, local community, subsidiary of a foreign company and a diplomatic and consular mission employing the worker on the basis of an employment contract.

Wage

A wage is composed of the basic wage, part of the wage for job performance and extra payments.

Minimum wage

"Minimum wage" shall mean the minimum monthly pay that a worker is entitled for the performance of full-time work.
A worker working part time shall be entitled to a proportionate share of the minimum wage.

Procedure


Government decides after consultation of the social partners

The amount of the minimum wage shall be determined by the minister responsible for labour after prior consultation with the social partners; it shall be published in the Uradni list Republike Slovenije (Official Gazette of the Republic of Slovenia) not later than 31 January of the current year.

Minimum wage set through decentralized collective bargaining

Wages may also be determined through collective agreement, provided that they are more favourable than those fixed by legislation.

Scope

The minimum wage applies to all employees in the private sector with no exceptions. All employers must pay a wage that is at least equal to the minimum wage.

In-kind allowances

Wages must, in principle, be paid in cash. However, eventual allowances in-kind may be allowed if provided in a manner laid down in the employment contract with regard to the nature of work and existing practice.

Scheduled frequency of adjustment

Once a year, the minimum wage shall be adjusted at least to the rise in consumer prices. The official data from the Statistical Office of the Republic of Slovenia on the annual rise in consumer prices for the previous December-to-December period shall be used in calculating minimum wage adjustments.

Enforcement mechanisms


Labour inspection

Supervision over the implementation of the provisions of the legislation and collective agreements (including the provisions of the Minimum Wage Act) shall be exercised by the Labour Inspectorate of the Republic of Slovenia.

Fines in national currency for non-respect of legislation

A fine ranging between EUR 3,000 and 20,000 shall be imposed on an employer for failing to pay a worker the stipulated minimum wage rate.

Notwithstanding the preceding paragraph, a fine of EUR 1,500 to 8,000 shall be imposed on a smaller employer that employs ten or fewer workers and commits the offence referred to in the preceding paragraph.
