Wage is what the employee is entitled to, in return for his work, in the terms of the individual employment contract or collective labour agreement and customary practice.

Procedure


Procedure in general

The Government, in consultation with the Labour Advisory Commission on Employment, shall set the national minimum wage or wages applicable to categories of employees whose employment conditions are such that the protection of these employees is warranted.

Minimum wage rates are discussed by the Labour Advisory Commission (CCT, Comissão Consultiva do Trabalho) with the participation of the social partners.

Minimum wages rates are set for 8 different sectors and cover workers employed in these sectors (see "specific minimum wage by sector" below).

In-kind allowances

Remuneration shall be paid:

a) in money or in kind, provided that the non-pecuniary portion, calculated on the basis of current regional prices, shall not exceed twenty five per cent ofthe entire remuneration.

Enforcement mechanisms


Labour inspection

The Labour Inspectorate shall monitor the legality of labour matters, and shall have power to supervise compliance by employers and employees with their duties.

Fines in national currency for non-respect of legislation

A person found guilty of an offence under the Labour Law is liable to a fine not exceeding 10 times the minimum salary per worker victim of the offence.
