LEGAL DEFINITIONS


Employee/worker

"Employee" shall mean a natural person who, as part of his or her employment, carries out certain tasks for the employer.

"Employer" shall mean a natural or legal person employing an employee and for whom an employee carries out certain tasks as a part of his or her employment.

Wage

Salary shall mean the payment made to the employee for the performance of the work assigned, following the employer’s instructions given according to the nature and type of work.

Salary is paid after the work has been performed.

Government decides after tripartite or bipartite body discussions/recommendations

The minimum wage is set by the Government upon its publication in the Official Gazette, after hearing the recommendations and proposals of the Economic and Social Council of Croatia about the coordination of the salary policy.

Minimum wage set through decentralized collective bargaining

An employer bound by a collective agreement shall pay to the employee a salary not lower than the amount established by the collective agreement.

The Economic and Social Council takes into account the social stability and the economic development of the country in order to make proposals for the coordination of the salary policy.

Scheduled frequency of adjustment

The legislation does not state how frequent the minimum wage shall be adjusted. However, as a reference, the minimum wage was increased in 2009 to 2.814 kunas per month, and since then the level of minimum wage has been frozen.

Labour inspection

The State Inspectorate monitors compliance with the Labour Act and labour regulations, among other provisions, those aimed to the protection of wages and working conditions of workers.

Fines in national currency for non-respect of legislation

A fine in an amount ranging from HRK 61,000.00 to 100,000.00 shall be imposed on the employer-legal person who fails to pay the employee a salary, salary compensation or severance pay.
