Employee/worker

Means any person, regardless of their sex or nationality, who has agreed to work in exchange for remuneration, under the management and authority of another person or public or private company, the employer.

Minimum interprofessional wage is the the minimum amount under which is forbidden to pay as wage to a worker. It shall be fixed through a decree.

Procedure


Government decides after tripartite or bipartite body discussions/recommendations

The government sets a national minimum wage rate for all workers. This rate is the floor below which no worker may be paid. The government may also set minimum wage rates for certain professions, in the event that collective agreements for workers in those professions do not provide minimum rates of pay.
The National Wages Committee provides the government with a recommendation on minimum wage fixing. The Committee is composed 4 representatives of the government and 1 representative each of the 4 most representative trade unions and employers organisations.

» Piece-rate workers

If the collective agreement of a certain sector of activity does not set forth the remuneration for piece-rate and task work, the employer is forbidden from practicing this type of remuneration.

Workers paid on a piece-rate basis must be paid at such a rate that a worker of average capabilities, working normally is paid a wage that is at least equal to the national minimum wage.

The minimum wage, as well as the conditions of payment, of piece and task work shall be displayed in the employers office and at the workplace.

In-kind allowances

Every employment contract imposing to a worker an effective change of residence, obliges the employer to provide with appropriate accomodation to the worker taking into account her/his family situation, or to pay her/him an indemnity of accomodation as compensation.

Whenever the worker is unable to provide a regular supply of food of first necessity, by her/his own means, the employer has to guarantee such supply in the conditions established in art. 144 of the present code.

Yes. The Cleiss report on Gabon’s Social Security indicates that the amount of 80.00 CFA Francs shall be paid monthly on the basis of a 40 hours working week.

Scheduled frequency of adjustment

The legislation does not set forth how frequently minimum wage rates should be adjusted; however, the National Wage Committee must meet at least once every three years.

Labour inspection

Labour Inspectors ensure that all provisions of the Labour Act are adhered to, including provisions on minimum wages. Inspectors have the power to enter workplaces in order to inspect documents and interview workers and employers concerning the provisions of the Act

Fines in national currency for non-respect of legislation

Any employer who fails to pay the stipulated minimum wage rate is liable to a fine of between 30,000 and 300,000 francs. In the event of a repeat offence, this fine is increased to between 60,000 and 600,000 francs, or imprisonment for two to six months:
