This case started with a contact from a seafarer to the ITF Actions Unit. Following various attempts to contact the owners, flag State and other concerned parties, contact was lost with the seafarers, no response was ever received from the owner or flag State and the local unions were unable to find further information.

According to Equasis the Registered Owner is Viewcom Sercies, Marshall Islands, the Ship Manager is given as Al Muanna/Al Qahtani, Moroni, Comoros.

Circumstances:The vessel has been in Montelimar since November 2006 when the engine broke down, since then other deficiencies have kept it in port. Crew complain of physical abuse by the Captain, who also withholds food, wages have not been paid since the crew joined the vessel in October and November last year. The vessel and manning agency, Sea Lane Poland, have a history with the ITF for non-payment of wages and substandard food. The Captain stopped buying food after the ITF inspector visited the vessel on 17 March 2008. The vessel was detained by Port State Control on 30 April 2008.

MI Flag Administration:
Subject vessel was detained by the Flag State on 2 July 2009. The Company's DOC was withdrawn, vessel's SMC/ISSC and Class as well at that time. The operators have since been non-responsive.


Other (7 September 2009)
MI Piraeus Managing Director, after not being able to make contact at the shipowner¿s office, stopped by their office to check what's going on...as was expected (since no phone calls had been previously answered), nobody was there. Another related Greek owner, ATLANTIC MARITIME, was contacted whereupon it was learned that the ship had been arrested by the Mortgagee and the case was being handled by Credit Europe Bank Netherlands NV. They provided the Administration with the contact person from the Bank, who was contacted.

A Mr. Murat told the Administration that someone else within the Bank was responsible for this case, but asked that he be sent an e-mail in order to forward to the contact person. This was done, but no response was received.

Other (8 September 2009)
MI legal counsel contacted ITF advising that the Marshall Islands Maritime Administration was recently made aware of the situation regarding the Alkistis and was currently looking into the matter.

Capt. D.J.F. Bruce, Permanent Representative to the IMO was informed along with the MI London Managing Director in case their assistance would become necessary. Attempts were made to seek out the manning agents and the ship agent in Abidjan. The Administration¿s first priority was to make sure that the crew had sufficient provisions.

The agents were determined to be GLOBAL MANUTENTION C.I. S.A. in Abidjan. An attempt was made to contact the agent without success.


Other (9 September 2009)
The crewing agent was determined to be Lizstar Enterprise CO. LTD in Myanmar for the Myanmar seafarers but was no help. No information was available with regard to the Philippine and Ukrainian crew members.

The ITF responded thanking the Administration for its quick replay. The Administration was advised that on 03-09-2009, the representative of the Bank, a Mr. Murat, visited the vessel and promised to make the payment of wages within 1-2 weeks. At present the status of Fresh Water was220t and provisions were delivered to the ship.


Other (10 September 2009)
Contact was again attempted with the Bank without success. It was then realized that the bank was avoiding the Administration. Continued attempts were made for a week without success.

Other (16 September 2009)
Notice was received from the IMO Secretariat of the situation requiring a response by 30 September. An MI Nautical Inspector was dispatched from Ghana to inspect the ship and assess the current situation while still trying to make contact with the Bank. The next step was to apply some legal pressure on the Bank with a little help from the ITF.

Other (22 September 2009)
Capt. Bruce discussed the issue with the ICFTU Rep at the IMO who in turn began to seek information from the local Abidjan ITF representative. London Managing Director began a dialogue with the ITF in London. The ITF confirmed the Bank had the vessel under arrest and that Mr. Murat was the local bank contact in Abidjan, further confirming that the bank was avoiding the Administration.

Other (29 September 2009)
23-09-09
Contact was finally achieved with the Bank, a Mr. Onur and the head of his legal team, Russel Welsh. The current financial arrangement with the owners had collapsed and the Bank was now the mortgagee in possession.

The vessel has been arrested by the cargo receivers for cargo damage (not so much), a shipyard and a supplier. One of the amounts is significant. The others are quite small. They are trying to negotiate a payout for the claims.

The crew will soon be paid off and repatriated, and the Bank is trying to engage a watchkeeping gang whilst at anchor. The Bank is worried the crew will cause damage to the ship and each other, and they want to maintain the vessel in a proper state.

29-09-09
The Administration is now awaiting the report of its Nautical Inspector and further progress on the part of the Bank toward payoff and repatriation of the crew. Although the pace is slow, the Administration is satisfied that the proper actions are taking place and that the situation of the crew will soon be resolved. Final resolution will be reported once accomplished.

Circumstances:Ship and crew abandoned, no contract on board, crew starving and requesting repatriation. The ship is substandard in all aspects, having main engine and hull deficiencies, inadequate fire fighting equipment and unacceptable working and living conditions. The ship is under arrest by the Port State Control following the discovery of false documents. The apparent flag State of Cambodia denies any knowledge of the vessel in its register. The ship was originally abandoned at anchorage, but on 01 June was moved to a berth. The ITF inspector, together with the local seamen's club have been supplying food to the crew. In the absence of an owner, the authorities were unable to embark upon legal proceedings against the vessel, however the court did eventually accept the case pleaded by a lawyer on behalf of the crew. The first hearing took place on 21 June, but no decision was taken. On July 4th a hearing found in favour of the crew and the vessel is expected to be sold next month.

UPDATE: The total amount owing to Filipino seafarers that were repatriated in December 2003 is US$224,604.09. The courts found in their favour however, it has not been possible to enforce the decision due to the closure of the manning agency, Alliance Maritime Support Services Inc., and the disappearance of the owner of the company. It is understood that the shipowner, - China Sea Cruises, is a co-defendant, but there are limited possibilities for pursuing the case against him due to reasons of location.

UPDATE: Total backpay recovered. Repatriation of all crew effected by the ITF however, reports indicate that the Nigerian seafarers were detained on arrival in Nigeria. ITF is endeavouring to clarify the situation.

International Shipping Federation (13 April 2006)
At the present time, the ship is berthed at North Dock in Algecira's port. The ship was detained due to the multiple shortcomings found in several inspections on Port State Control. A shipowner's representative reported that their intention was to repair the ship but they have not done anything as yet. The crew are no longer on board following intervention by the Nigerian Consulate.

Report received from Port Captain Algesiras (Spain), Port State Control Office, stating that the vessel "Presently berthed and detained since 25 April 2005 at the port of Algesiras, due (to) severe deficiencies affecting maritime safety and environment. /.../ a report made by the crewmembers describing present conditions on board the ship, among others, non payment of wages, unhygienic conditions, lack of weather clothing protection, etc. All of them show a systematic rupture with basic compliance of ILO requirements".
Copy was sent to the Nigerian Embassy in Spain by the PSC authorities.

ITF (21 January 2008)
The vessel remains under detention by PSC in Algeciras without crew on board. Seven Indian seafarers have been repatriated. The ITF inspector is still waiting to recover the 30% balance of crew¿s outstanding wages. The fate of the original crew who returned to Nigeria is not known.

UPDATE: Since the problems reported by the ITF occurred it is noted that the vessel has been twice detained by Port State Control - in Ravenna, Italy for 18 days with 25 deficiencies and in Eleusis, Greece for 5 days with 14 deficiencies.

ITF (21 January 2008)
This vessel changed name to Balcar on 31 March 2007. Flag now seems to be Bolivian. The vessel has been operating in the Black Sea since the beginning of 2006. In September this year the ITF received a call from one of the current crew complaining of unpaid wages of the 11 Ukrainian seafarers on board, no food and little water. Ship manager claimed that crew would be repatriated and that food and water problems would be resolved, however it was not possible to verify this due to loss of contact with crew.
The ship manager and operator is Petunia Shipping Srl, Italy, the DOC company is GM Trading & Chartering and the registered owner is Aileen Corporation, Panama.

Crew were effectively deported, wages not paid, unclear as to whether vessel is still owned by the same company.

Supplies will be replenished, i.e. food, water, Gasoil, luboil on BMS cost.

Wages now partially paid, however there remains an outstanding issue regarding overtime. Although the vessel was auctioned it failed to reach the reserve price. The crew have now been repatriated.

After making his claim , the Master has received threats that his children will be hijacked. Chief Engineer advises that contracts have been signed by the crew stating that if they contact the ITF or similar in the event of a wage claim, they will be liable to fines of US$15,000 in Pakistan.

ITF (14 July 2006)
UPDATE: There is now only one Pakistani seafarer remaining on board, four other crew members were repatriated on 5th June. There is no contact with the owner.

ITF (21 January 2008)
The crew members were repatriated and provided with some support funds at the expense of the ITF. The vessel remains in the port of Rijeka awaiting sale. The judge appears unwilling to apply new legislation that would allow the immediate sale of the vessel based on three offers from recognised international ship brokers. It is unlikely that the owed wages will be recovered due to the high cost of port dues.

Circumstances:The crew contacted ITF in June 2006. They had not been paid since January, were running out of supplies and wanted to go home. The original owners (Cargo Logistics USA) renounced responsibility claiming to have sold the vessel in 2004 to another company (HPS Trading Corp), however connections between executives in both companies would suggest that there was no genuine change of ownership. The company¿s representative (who did not change after the apparent sale) refused to supply provisions, wages or any form of assistance. The crew were forced to subsist through the charity of other Filipino seafarers, the Filipino community in the Bahamas. Assistance was also provided by the Philippines Consulate in Washington and the manning agent (Crewlink) who subsequently funded the crews¿ repatriation.

Information provided by flag state (Government of Panama):A note has been sent to the legal representative, as well as to the operator/owner of the ship. At the same time, all related procedure has been restricted, which impedes her to leave the register without accomplishing its obligations. Until this moment, only 6 seafarers have been repatriated and the Vietnamese authorities, where the ship is located, are taking actions to order the owner to take his responsibilities.

Reported that the shipowner had not provided funds since December 2003. Actions undertaken locally - case reported to the Maritime Labour Inspection, and the Labour Court.

Circumstances:Message from seafarers received by ITF affiliated union, PSU, in Pakistan asking for assistance. The vessel has apparently been under arrest by the charter party since last year. The crew have been on board for 14-15 months. The owner has refused to pay four months outstanding wages and repatriation costs.
After the crew requested help from the port authority the Captain (newly joined) has apparently, on the order of the owner, refused to allow them back on the vessel. As a result the crew have been housed in a shelter at the terminal since 10th March 2008.

Circumstances:Following engine failure, the vessel was towed to Cochin in August 2008. Legal proceedings brought by the towage company ensued. Four of the original nine crew, including the Master and Chief Engineer were repatriated in September 2008.

Tried to contact the Owner through e-mail and phone several times but it was in vain. When the Tug¿s Agent also abandoned the ship ITF inspector and union went to local court praying payment of wages and compensation under Sec. 145 of Indian Merchant Shipping Act. Court had issued detention of the vessel at Cochin Port. Hearing at the Court is progressing.

Informed by flag state (Government of Panama):A note has been sent to the legal representative informing on the seafarers situation. Until this moment, they did not respond although contact has been made on several occasions with the contact agent in order to have them responding to this complaint. The Maritime Authority was not able to communicate with the ship owner as it does not have the owner's electronic address and fax number.

Dear Mr Librando,
I would like to thank you for your assistance in providing the contact details for the Permanent Representative of Spain and the Director General of the Merchant Marine in Spain.
As a follow-up to my email of 20/03/2006, kindly be advised that the Harbour Master's Office - Santander has informed that the vessel was not "arrested/detained". Furthermore, the current situation, as related by the Harbour Master's office states that there is no crew presently aboard the
vessel which is still in Santander, the main engine of the vessel is destroyed and there is no known management for the vessel. It was also advised that court proceedings are underway.

Please be guided accordingly.

International Shipping Federation (13 April 2006)
No crew members on board. At present no ship agent. When the ship arrived at Santander port, the shipping agency was "Bergé Marítima" but last 30th May this agency renounced the ship. Now the ship is detained following the orders of two District Courts in Santander. It has declared a distraint procedure. The ship has no propeller machinery, communication equipment (it was removed) and is not under command. The Santander Maritime Authorities are now instructing an enquiry in order to declare the abandonment. Once concluded the competent maritime authority will require the Courts to order an auction.



ITF (14 July 2006)
UPDATE: May 2006 - the court judged in favour of the seafarers allowing the vessel to be auctioned. Legal claim to be lodged following notification of the judgement.

ITF (18 December 2006)
Legal claim still pending. End November 2006, the ship agent lost his claim against the Captain.
