Crew unpaid since 25 November 2016. Limited supplies of food & water. Main engine down and in need of repair. The vessel was covered by MLC A2.5.2 insurance with the Japanese Ship Owner’s P&1 dated 18 Jan 2017 – 20 Feb 2017. ITF applied to them on behalf of the crew on 09 Feb 2017, acknowledgement received, but no further details as yet. It is understood that the owner is bankrupt. The Indian embassy have been informed and have arranged visa extension for the crew while they make the claim.

Dear Mr de Boer,

I refer to your e-mail of 22.2.2017 as attached regarding a crew abandonment case of a Hong Kong registered ship MV “Liberty Prrudencia” (“the ship”), IMO No. 9250141.
The ship is now anchored off a shipyard in China due to the malfunction of the main and auxiliary engines at sea in early December 2016. During that period, owners and technical managers worked round the clock to save the life of crew onboard and engaged salvage company to tow the vessel to safety. It took around 30 days to rescue the crew and the ship amid various difficulties, such as bad weather and restriction of local administrations, etc.
To maintain the daily living of the crew onboard in cold weather, upon the ship towed to the shipyard on 10 January 2017, the owner had immediately arranged the provision of a shore generator on board with the food and water supply provided from time to time since then.

According to the latest e-mail from all the crew on 4 March 2017, they would accept the owner’s offer and have the other one month's salary to be paid afterwards. Although it is alleged that the owner has been in a state of financial difficulties and there are disputes between the owner and the crew on the outstanding wages, at this point of time, Hong Kong, China is of the view that the case may be resolved very soon.

‘About Liberty Prrudiencia, nothing from P n I and the owner. We are requesting for the repatriation for crew, however, now seems the local PSC not allow for reduce for crew on board so they not agree crew sign off. Still working with India embassy/HKG Flag state/ local agent. Hope some news from Authority this week.’

Dear Mr. de Boer,
Thanks for your e-mail.

Hong Kong, China is well aware that there is no significant progress on crew repatriation and settling of outstanding wages since my last e-mail in March. We are also very disappointed with the crew situation onboard. From time to time, we keep on asking the owner/management company to provide sufficient food and provision on board and to resolve the problem at the earliest.

We were told by the management company that one month wages had been paid on 7 March 2017. They also said that the P&I cover on unpaid wages and repatriation cost had been expired on 20 Feb 2017 and unable to renew because of the outstanding wages matter.
Hong Kong, China always endeavours to discharge our obligation as a flag administration to protect the interest of the seafarers. We did attempt to arrange a Flag State Quality Control inspection of the vessel, but the owner gives no response. Nevertheless, we assure that we treat this case very serious and by all means to let the crew to be repatriated soonest.

Here is the latest development of the case.

The Master and 15 crew members received the wages till end of May from new buyer.

As per the Settlement Agreement, the company will pay the wages of 1 June to 20 June in cash when the crew sign-off.

Now the crew is waiting for the repatriation arranged by the company.

Dear Katie,

I received the email below from the Master of Liberty Prrudencia, the good news is that all abandoned seafarers had been repatriated with most of their wages.

Master confirmed that the balance of wages as per Settlement Agreement had been paid in cash on board, i.e. The crew received the wages till End of May in their bank accounts on 12/7/2017 and the wages from 1 June to 15 June paid in cash on 22/7/2017.

Total US 264,600 had been back paid to 16 seafarers who stranded in China from 8-13 months.

Then all crew sign-off on 22 July and hand over the vessel to new crew.

On 23 July Master and the other 15 crew members had been repatriated from China and reach India safety.
