INTRODUCTION:
Under the Factories and Machinery Act (FMA), Section 18, stated that no person shall manufacture, repair or install machinery ( includes steam boilers) in such a manner that it does not comply with the provisions of this Act and regulations and no person shall import any machinery other than transmission machinery which does not comply with any regulations made under this Act.

By attending this course, the participants will be able to understand all the legal requirements with regard to steam boilers.

World Day for Safety and Health at Work

BACKGROUND

The concept of having a World Day for Safety and Health at Work is rooted in the Workers Memorial Day, which was started by American and Canadian workers in 1989 in order to commemorate dead and injured workers annually on 28 April.

The International Confederation of Free Trade Unions and Global Union Federations made this into a global event, expanding its scope to embrace the notion of sustainable work and workplaces. The International Commemoration Day for Dead and Injured Workers is now observed in over one hundred countries.

On 28 April, the International Labour Organization (ILO) World Day for Safety and Health at Work will be celebrated. Governments, employers and workers will together raise awareness of the benefits of safe, healthy and decent work. Ministers will make speeches, experts will discuss best practices and many people will participate in public event. They will all be promoting the importance of safe, healthy and decent work.

Safe work is at the heart of the ILO¿s Decent Work Agenda. The Agenda represents the ILO¿s strategy for governing globalization, promoting sustainable development, eradicating poverty, and ensuring that people can work in dignity and safety. Safe and healthy work is essential to achieving all four of the strategic objectives that make up the Decent Work Agenda:

1. International labour standards and fundamental principles and rights at work
2. Decent employment
3. Social protection for all
4. Tripartism and social dialogue

In NIOSH Malaysia, World Day for Safety and Health at Work or WORLD OSH Day are celebrate on 4th May 2007.

Implementation of Notification of Accidents , Dangerous Occurrence, Occupational Poisoning and Occupational Diseases (NADOPOD) and Accidents Investigation Seminar

Under section 32(1) of OSHA 94, requires all employers in every sector to notify the nearest DOSH office if any of the following has occured.

The penalty for non-compliance is RM10,000 or one (1) year jail or both.

In Malaysia , the two main legal references for OSH are the Factories and Machinery Act 1967 and the Occupational Safety and Health Act 1994. The implementation and application of the Acts may differ between organization due to the different work tasks and hazards faced in the various industries. In the year of 2006, Factories and Machinery Act 1967 has been amended and cited as Factories and Machinery (Amendment) Act 2006. The amendment inclusive of Section 2, 3, 5, 6, 8, 9, 22, 31, 32, 33, 36, 37, 38, 41, 44, 48, 51, 52, 55, 56 and Third Schedule . It also involved an introduction of new Section on 7A, B, C, D, E and F, Section 29A, Section 47A and 51A.

Regulation 10 of the Occupational Safety and Health (Notification of Accident, Dangerous Occurrence, Occupational Poisoning and Occupational Disease) Regulations 2004 requires employers to maintain records of all accidents, dangerous occurrences, occupational poisonings and occupational diseases.

Factories and Machinery (Amendment) Act 2006 and Occupational Safety and Health (Use and Standards of Exposure of Chemicals Hazardous to Health) Regulations 2000 requires the use of personal protective equipment (PPE) to reduce employee exposure to hazards when engineering and administrative controls are not feasible or effective in reducing these exposure to acceptable levels.

Hence this seminar will highlight all these 3 issues in ensuring compliance to Factories and Machinery (Amendment) Act 2006 , managing workplace accidents and occupational diseases effectively and determine the right personal protective equipment to protect employees at the workplace.
