Reregulates the granting of international protection to an alien, the legal status of an alien who is applying for international protection and of an alien who has been granted international protection and the legal bases for his or her temporary stay, residence and employment in Estonia on the basis of treaties and the legislation of the European Union. Article 10 and 45 of the Law deal specifically with employment of Asylum seekers.

The aim of the Act is to ensure the protection of the rights of workers from a foreign country who have been posted in Estonia in the framework of the provision of services, and fair competition between employers involved in the provision of services. It applies to workers posted in Estonia by their employer for a temporary period. The Private International Law Act is to be the applicable law in deciding what law to apply to the employment contract. The more favourable law (Estonian or law of the other country) is to be applied with respect to employment conditions. The Act also sets out the working conditions to be adhered to, provides for dispute resolution, State supervision of working conditions. It implements the European Parliament and EU Council directive 96/71/EC concerning the posting of workers in the framework of the provision of services.

Provides for general conditions of permits delivery and, inter alia, cases of refusal (lists the reasons to be considered, as when the security of the State is threatened). A military officer can be granted a permit if his wife or minor child is a citizen of Estonia. A retired military officer can obtain a permit if his wife or minor child is a citizen of Estonia, if he was born before 1 January 1940 and if he is recognized as an invalid needing help. Promulgated by Decree No. 130 of 14 May 1996.
