This Notification applies to private undertakings under the Act of 23 April 1990 (Text No. 105) whose workforce does not, generally exceed 200 employees. Its provisions supplement those of the Ordinance of the same date respecting labour relations in such undertakings (Text No. 121). It sets out a scale of basic wages and provides for remuneration in respect of overtime, stoppage imputable to the undertaking, nightwork, home-work, hazardous work, work on weekends, etc. Employers are required to bring this Notification to the attention of their workers. Examples of occupations classified by wage step are given in a schedule.

Amends the Enterprise with Foreign Property Participation Act, No. 173 of 1988. Under the new Act, foreigners may establish wholly-owned subsidiaries or purchase up to 100 per cent of an existing firm; investment may be made in stock corporations, limited liability companies, limited partnerships, general partnerships, and limited partnerships with shares; investment in "associations" (under an older act)is still permitted; and, for the first time, the Czechoslovak partner (if any) may be a natural person. The new Act also simplifies authorisation requirements, eliminates certain technical formalities and allows joint venture contracts to be governed by foreign law.

This Act is intended to provide more scope for foreign economic activity and open up the Czechoslovak economy to the outside world by relaxing the rules on economic relations with foreign countries; allowing Czechoslovak natural persons to engage in foreign economic activity-in principle on the same terms as legal persons; reforming the system of registration and authorisation to carry on economic activities with foreign countries; and providing for security deposits, administrative formalities, individual membership of the Czechoslovak Chamber of Commerce and Industry and other matters. Authorisation granted under the previous Act on this subject is automatically recognised as authorisation or registration under the amended version. However, Czechoslovak organisations trading with CMEA countries under Section 7 (2) (b) of the previous Act must be registered or authorised to do so within three months of the entry into force of the new Act. Amends Act No. 42/1980 Coll., on Economic Relations with Foreign Countries in the version of Act No. 102/1988 Coll, and amends and repeals many other statutory provisions concerning foreign trade and related matters (section 63). Under the new Act, the establishment of joint stock companies is not subject to clearance or supervision by the State, and a provision for establishment by a single founder having legal personality and underwriting the entire stock enables the State to transform existing enterprises into joint stock companies. This Act consists of five parts. Part I, entitled General Provisions, begins as follows: "Any citizen may carry on entrepreneurial activity in his personal capacity subject to the restrictions and conditions prescribed in this Act". No limit is imposed on the number of his employees or on the amount of his capital. The other parts are respectively entitled "Requirements to be met by entreprenuers" (registration of enterprises and other administrative provisions). This Act, which contains six Parts, has as its purpose to issue "provisions, legal measures and operational principles" for enterprises considered to constitute "basic elements of the national economy" having a social aim in the implementation of the state plan. According to Part I (Introductory provisions), this embraces all workers of the enterprise who are in an employment relationship within the meaning of ss. 27 et seq. of the Labour Code (LS 1975 - Cz. 2 (cons.)), excluding those in a subsidiary employment relationship (s. 70 of that Code). Save exceptions (for example, liquidation under s. 251 of that Code), the enterprise and the State have independent responsibilities; in case of a dispute, resort may be had to "economic arbitration" pursuant to the Economic Code of 1964 (Part II: Rules and operations of the enterprise). The other Parts of this Act deal respectively with the following: establishment, registration and dissolution of the enterprise; management organs of the enterprise and socialist self-management; "socio-economic functions" within the meaning of the Economic Code; social development of the workers' collective, and common, transitional and final provisions (Part VI, indicating 1 July 1988 as the date of entry into force).

This text makes applicable, unless otherwise indicated, the Principles and Procedures of 11 Feb. 1988 (Text 31) and, with regard to the reorganisation of "central bodies", the Notification of 3 July 1970 (Text 74). At least three months' notice shall be given to an employee in case of termination of the employment relationship, and the employee shall be granted assistance in seeking new employment. If necessary, he or she shall receive the difference between his or her previous average earnings and the average earnings in the new job for the first three months of new employment, and 80 per cent of this difference over the following three months. The same shall apply in case of a change affecting the enterprise, as stipulated in s. 46(1)(a) to (c) of the Labour Code (LS 1975 - Cz. 2) and in case of restructuring or reduction in force. Acquired rights shall be fully maintained for purposes of ss. 249 to 251 of the Code.

This Act contains eight Parts (General provisions; establishment, operation and dissolution of co-operatives; management and organisation of co-operatives; members of the co-operative and their employment relationships; use of co-operative lands; basic means of co-operative arrangements; Association of Agricultural Co-operatives; and common, transitional and final provisions. The following are noted in the last Part as being repealed: Act of 1975 on the same subject; Parts II and III of the Ordinance of 1975 issued under that Act; the Ordinance of 1975 issuing model regulations for united agricultural co-operatives and procedural rules for drawing up, approving and amending those regulations; the Notification of 1975 regarding co-operation in agriculture and the forms it should take; and the Notification of 1975 regarding procedures to follow in united agricultural co-operatives. Entry into force 1 July 1988.

This Act, which contains six Parts, has as its purpose to issue "provisions, legal measures and operational principles" for enterprises considered to constitute "basic elements of the national economy" having a social aim in the implementation of the state plan. According to Part I (Introductory provisions), this embraces all workers of the enterprise who are in an employment relationship within the meaning of ss. 27 et seq. of the Labour Code (LS 1975 - Cz. 2 (cons.)), excluding those in a subsidiary employment relationship (s. 70 of that Code). Save exceptions (for example, liquidation under s. 251 of that Code), the enterprise and the State have independent responsibilities; in case of a dispute, resort may be had to "economic arbitration" pursuant to the Economic Code of 1964 (Part II: Rules and operations of the enterprise). The other Parts of this Act deal respectively with the following: establishment, registration and dissolution of the enterprise; management organs of the enterprise and socialist self-management; "socio-economic functions" within the meaning of the Economic Code; social development of the workers' collective, and common, transitional and final provisions (Part VI, indicating 1 July 1988 as the date of entry into force).
