Requires employers who employ night workers to carry out an assessment of the health and safety risks attached to the work of night workers whom they employ with a view to determining whether that work involves special hazards or a heavy physical strain. Also requires employers, whose night workers become ill or exhibit symptoms of ill-health as a result of performing night work, to re-assign such workers to day work suited to them whenever possible.

Made under Safety, Health and Welfare at Work Act 1989. Gives effect, in respect of night workers and shift workers, to safety and health protection provisions of Article 9 of EU Directive 93/104/EC concerning certain aspects of organisation of working time. Inter alia requires employers who employ night workers to carry out asessment of health and safety risks facing night workers they employ. Also provides for some related obligations of employers.

Council Directive 92/85/EEC deals with the introduction of measures to encourage improvements in the safety and health at work of pregnant employees, employees who have recently given birth and employees who are breastfeeding. These Regulations provide for the introduction of a new Health and Safety Benefit Scheme (which will operate on an interim basis) for employees covered by the Directive who are exposed to a specific risk to their health and safety, pregnancy or breastfeeding, or who are required to do nightwork and whose employer cannot assign them to suitable alternative work.
