Act to amend the Canada Evidence Act and the Criminal Code in respect of persons with disabilities, to amend the Canadian Human Rights Act in respect of persons with disabilities and other matters and to make consequential amendments to other Acts (Chapter 9).

Amends the Criminal Code to make it an offence to sexually exploit a person with disabilities in a situation of dependency. Amends the Canadian Human Rights Act to provide protection from discrimination against disabled persons in the federal sphere. Adds a provision requiring employers and service providers to accommodate the needs of disabled persons. Also sets forth penalties for hate messages and establishes a Canadian Human Rights Tribunal.

The Guidelines are issued under s. 11 of the Canadian Human Rights Act (C.S. 1976-77, Chap. 33). They indicate the factors that may justify a difference in wages between men and women performing work of equal value in the same establishment. They set forth in particular the criteria for determining equal work and the factors considered reasonable to justify differences. The Guidelines also deal with the handling of individual and group complaints alleging discrimination.

Toute personne employant entre 10 et 50 salariés doit déterminer les ajustements salariaux nécessaires afin d'accorder, pour "un travail équivalent", la même rémunération aux salariés occupant des emplois dans des catégories d'emplois à prédominance féminine que celle accordée aux salariés occupant des emplois des catégories d'emplois à prédominance masculine. Tout employeur de plus de 50 salariés doit établir un programme d'équité salariale, qui doit être mis en place dans un délai de 4 ans. Ce programme comprend 4 étapes: identification des catégories, description des méthodes et outils d'évaluation, estimation des écarts salariaux et calculs des ajustements nécessaires, et modalités de versement des ajustements. L'équité salariale doit par la suite être maintenue dans l'entreprise, notamment lorsque des emplois sont créés ou lorsque qu'une convention collective est renouvelée. Une commission de l'équité salariale est instituée. Elle est composée de 3 membres nommés par le gouvernement, après consultation des organisations les plus représentatives des employeurs, des salariés et des femmes. Ses attributions sont précisées (assistance dans l'élaboration du programme, enquêtes à la suite de différends, recours, etc.).
