Trade Union Act No. 2821 of 5 May 1983 and Act No. 2822 of 5 May 1983 on collective agreement, strikes and lock-out are repealed as well as Article 1 paragraph (A) of the Labour Courts Act No. 5521 of 30 January 1950.
All references to Acts No. 2821 and 2822 made in other legislation shall be referred to the present Act.

Makes various amendments to the principal Act. Changes the title of the Act to "Act on Public Employees' Unions and Collective Bargaining". Makes various changes to membership of unions including allowing for public employees to become union members during their employment probation period and senior employees and their assistants in workplaces of more than 100 employees may join unions. The requirement of two years service before being able to found a trade union has been abolished. Matters which are to be included in unions' and confederations' statutes have been simplified. The functions and rights of workplace union representatives have been set out and a Public Employee Advisory Board established.

Prohibits the adoption of names, labels and brands belonging to political parties as well as the granting of donations to them. Removes the power of the state to exercise an administrative and financial control over trade unions.

Modifications notably concern the right of the worker to withdraw from a trade union, the possibility of dissolving a trade union and the preliminary approval of the government for all affiliation to international organizations. The Act also amends certain arrangements concerning the prohibition of political strikes, essential services and sentences of imprisonment which can be pronounced against the members of a trade union who participate in strikes.

This Act amends the Trade Unions Act (LS 1983 - Tur. 1A) in relation to the conditions applicable to founding members (s. 5) and the documents which must be furnished to the provincial authorities in order to establish a trade union (s. 6). It also amends s. 9 (functions of executive officers, number of representatives in general congresses and other organs), s. 11 (functions of the general congress) and s. 14 (electoral procedures; ten years' active employment required for candidates for office in mandatory organs). Changes have also been made in the rules governing membership (ss. 22, 25 and 31), functions of shop stewards (s. 35), expenditures of trade unions and confederations (s. 44), transfer of assets and audits (ss. 46 and 47), removal from office (s. 53), penal provisions (s. 59) and dues check-off (s. 61). The provisions prohibiting trade unions from engaging in certain activities have been reformulated (s. 37, second para.). Finally, in s. 21, clauses 3 and 4, which prohibited students and persons carrying out religious functions and services from establishing a trade union, have been repealed. The amendment Act also contains transitional provisions.

Act No. 3451 of 25 May 1988 concerning the amendment and the annulment of some sections of the collective agreement, strike and lock-out Act No. 2822.

The amendments require the trade union to communicate its membership registration forms to the employer within three working days of applying to the Ministry to conclude a collective agreement (amended s.13) and exclude a trade union which does not represent at least ten per cent of the workers employed in the branch or activity in which it is constituted from pursuing an appeal in a jurisdictional dispute (amended s.15). In cases of disputes in general, mediation procedures may begin immediately (amended s.22). Clauses 3 and 5 of s.29 (activities and services where strikes and lockouts are prohibited) have been amended, as have the first and third paragraphs of s.38 (obligation to leave the establishment in the event of a strike or lockout). The number of pickets permitted has been increased to four (amended s.48). The amendments also address the High Court of Arbitration (s.53), mediation fees (s.59) and penalties in case of an employer's infringement of workers' rights (s.78). The second paragraph of s.31 (reference to state of emergency or martial law in relation to temporary prohibitions) and the first paragraph of s.32 (renewal of a collective agreement where a strike or lockout is not permissible) are repealed.

Establishes principles governing associations which have been formed by at least seven persons on a permament basis with a view to realising a specific objetive which is not prohibited by law. Part II regulates foundation of associations, and establishes which associations are prohibited. No associations shall be founded which contravene fundamental principles laid down in the Constitution. Also prohibits foundation of associations which claim that minorities based on racial or linguistic differences exist on the national territory. Part VII sets forth sanctions for persons belonging to, and participating in activities of, prohibited associations.
