This is the substantially revised version of the Constitution of 1990, which is repealed. Chapter II sets forth a code of conduct for the government, which provides for the freedom religion, the recognition of the rights of Fijian and Rotuman people, power sharing, and affirmative action to ensure equal treatment and access for Fijian and Rotuman people. Chapter IV contains a Bill of Rights. Provides for right to life, freedom from inhuman treatment, freedom of expression, assembly, association, and the right to bargain collectively. Art. 24 provides freedom from forced labour, which, however, shall not apply "labour reasonably required as part of reasonable and normal communal or civil obligations." Art. 38 provides for equality and prohibits discrimination on the basis of gender, race, ethnicity, sexual orientation, disability, and economic status. Art. 42 establishes a Human Rights Commission. The subsequent chapters outline the structure of the government, including the Parliament (House of Representatives and Senate), Executive Government, the Bose Levu Vakaturaga (Great Council of Chiefs), the Judiciary, and State Services. Chapter XI deals with accountability, sets forth a code of conduct for the government, and establishes the post of ombudsman. Chapter XIV allows the Parliament to make a law conferring power to the President to declare a state of emergency. In such a case, a law may derogate from certain freedoms and rights, including freedom of association and collective bargaining.

The new Constitution, promulgated in the Schedule to the Decree, restores traditional chiefly leadership and emphasises traditional culture (Art. 3 expressly recognises the Great Council of Chiefs and Art. 100 provides for the application of customary laws and for the powers of the Native Lands Commission); promotes opportunities for Fijians and Rotumans in the civil service, business, trade, education, etc (Chapter III); and secures the political dominance of indigenous Fijians (Chapter VI). Art. 28 precludes dual citizenship. Chapter II is a bill of rights reminiscent of the 1970 Constitution, except for Art. 18 providing for the possibility of action in favour of disadvantaged individuals or groups. Art. 134 establishes an ombudsman. Art. 162 prescribes the circumstances in which an Act of Parliament may override the provisions of Chapter II, and Art. 163 provides for emergency powers. Under Chapter XIV, the leader of the military coups of 14 May and 25 September 1987 and his followers are immune from prosecution for any actions connected with the coups. The Judicature Decree 1988, the Fiji Service Commissions Decree 1988, the Public Service Decree 1988 and the Protection of Fundamental Rights and Freedoms of the Individual Decree 1988 are repealed.
