Contains ten articles:
1. Establishes the Integrated Team for the Protection of Indonesian Workers Overseas
2. Sets out the functions of the Integrated Team. These include a) inventory the whole issue of placement and protection of emigrant workers; b) evaluate the policy, legal framework, and mechanisms relating to the placement and protection of emigrant workers; c) reviewing the Memorandums of Understanding relating to the placement of emigrant workers between the Government of Indonesia and Destination Governments; d) conducting evaluations of the handling of problems emigrants face overseas; e) making recommendations to take measures to settle issues related to emigrant workers.
3. Sets out the composition of the Integrated Team. The team is to be Chaired by the Minister of Manpower and Transmigration. Other members include representatives of other ministries as well as Cabinet.
4. The Integrated Team is to be assisted by a Technical Team established by the Chair.
5. Work procedures of the Integrated Team shall be further governed by the Chairperson.
6. The Integrated Team is to report to the President.
7. The Integrated Team may involve any Ministry/Government Institution, stake-holder, academics and other parties it deems necessary in order to carry out its functions.
8. The Integrated Team is to take effect for 6 months following the entry into force of this Decree.
9. All cast will be charge to the State revenue and Expenditure Budget.
10. The Decree takes effect on the 14/06/2011.

In order to obtain a licence, recruitment agencies need to fulfill administrative and technical requirement including the ownership of use of accommodation for prospective migrant workers (Arts. 2-3). It provides that seperate facilities are to be provided for men and women, provisions concerning the size of beds, content of the bedrooms, specifications for walls and floors, health and hygiene measures as well as provision of facilities such as rest rooms, guest rooms, worship rooms, clean water, fire extinguishers, washing and cleaning facilities etc. (Art. 4).

Sets out regulations to protect Indonesian workers who are placed in employment overseas.
Chapter I: Stipulates that placement shall be based on integrity, equality of rights, democracy, social justice, gender equality and justice, anti-discrimination and against trafficking of persons;
Chapter II: sets out the responsibilities of the Government including the obligation to regulate, develop, operate and supervise the recruitment and placement of Indonesian workers overseas and improving protection of Indonesians abroad;
Chapter III: sets out the rights and obligations of Indonesian migrant workers including the right to equality of rights and opportunities;
Chapter IV: sets out the duties of placement services, both government and private. Private recruitment and placement agencies must, inter alia, place a deposit in a bank before they can obtain a licence. The Indonesian embassies are to evaluate the business partners and users with whom recruitment agencies place workers. Those business and users that do not meet the criteria are to be put on a black list;
Chapter V: sets out the procedures for placement of workers including assistance throughout the migration process, signing of employment contracts, education and training, costs etc;
Chapter VI: regulates the protection of migrant workers;
Chapter VII: regulates dispute settlement;
Chapter VIII: regulates development of all activities related to the placement and protection of Indonesian migrant workers;
Chapter IX: regulates supervision;
Chapter X: establishes the Placement and Protection Agency;
Chapter XI: stipulates the administrative sanctions for violations of the Law;
Chapter XII: sets out rules for investigations;
Chapter XIII: provides criminal sanctions;
Chapter XIV: sets out other provisions;
Chapter XV: sets out the transitory provisions.

Implements Art. 42(1) of Law No. 13 of 2003 on Manpower. Provides that expatriates must have a minimum of 5 years professional experience, be willing to make a statement that they will transfer their knowledge and skills to Indonesian workers and be able to communicate in Indonesian language (Art. 2). There is a compensation fee to be paid into the Skill and Development Fund (DPKK) of US$100 each month for each expatriate employed (Art. 6). All changes of employer and location of the workplace is to be notified to the competent authority (Chapters VII-IX). Repeals Ministerial Decee No. PER-03/MEN/1990 and Decree No. Kep.416/MEN/1990.

The purpose of the Act is to control immigration as well as the residence as the residence and activities of foreigners in Indonesia, to create awareness of negative impacts of international migration in view of national stability and security and public order. The measures of control regulated include, inter alia, data collection on foreigners at entry and exit from Indonesia, and on their stays in hotels, and requires every foreigner residing more than ninety days in Indonesia to register with the local authorities. Decisions regarding immigration must be rendered within seven days and can be appealed to the Minister of Manpower. Foreigners may be placed in "Immigration Quarantines" if they are illegal residents, pending deportation or appeals.

These regulations detail the procedure to obtain an approval (SPP) and a license for the recruitment of workers domestically and overseas (SIUP-PJTKI) and to operate recruitment services domestically and overseas. Indonesians intending to work abroad must, inter alia, be at least 28 years old. Coverage for the costs of recruitment may be collected both from the prospective worker and employer, but must be based on itemized estimations approved by the Ministry of Manpower. Fees payable by the prospective worker may be collected through monthly installments taken from his future wages. The recruitment process includes a training period with language training, a pre-departure orientation as well as an aptitude test. Prospective workers are required to participate in a workers' social security system in the country of employment. However, a recruitment company is in any event required to provide insurance coverage for occupational accidents as well as life insurance for prospective workers to be employed with an individual employers. For workers to be employed by an agency, an institution or a company the recruitment company is responsible for paying the national social security system fees for two months as of the undertaking of the journey abroad.

All recruitment of workers, domestically or overseas, is regulated. Public recruitment entities must have an approval (SPP) by the appropriate ministry and private entities must have a license (SIUP-PJTKI). The regulations prescribe the procedure to obtain a SPP and a SIUP-PJTKI. A private entity seeking a SIUP-PJTKI must have a paid up capital of 375,000,000 rupiahs for a general recruitment license and 200,000,000 rupiahs for a domestic recruitment license. The approved and licensed entities are entitled, inter alia, to collect charges both from potential employers and workers, and are required, inter alia, to provide potential workers with certain vocational training at specifically designated Job Training Insitutes.
