Article 2 is amended so as to change the meaning of "Department" in the principal Regulations. "Department" shall be the Fisheries Resources Regulatory Services Department of the Ministry of Fisheries.

This basic text on fisheries in Eritrea makes provision with respect to fisheries management and conservation and aquaculture. The Ministry of Fisheries shall be responsible for the management and development of fisheries resources in Eritrea. There shall be a Fisheries Advisory Council which shall provide advice on the management and development of fisheries (sect. 6). The Minister shall prepare and keep under review fisheries management plans in accordance with section 7 and shall base fisheries development programs on such plans. Fisheries principles are set out in section 8. Section 12 provides for the protection of certain fish species. Sections 14 to 24 concern the granting of foreign fishing vessel licenses and national fishing vessel licenses and deals also with access agreements, the stowage of gear, and license fees. Fish farming requires an authorization by the Minister issued in accordance with provisions of sections 25 to 28. Various powers of enforcement are described in sections 29 to 34, whereas sections 35 to 46 provide for offences, penalties, liability, settlement, and enforcement measures. The Minister may make Regulations for the implementation of this Proclamation.

These Regulations make provision for the granting of national and fishing to fishing vessels, lay down some rules relative to operations of those vessels in Eritrean waters, and prescribe offences and penalties. Vessels that are not motorized or motorized but not exceeding four meters of overall length and vessels used exclusively for recreation fishing shall not be required to operate under a license (art. 3). Applications for a national fishing vessel license shall be made to the Head of Department of the Ministry of Fisheries (art. 4). Article 6 makes provision with respect to fees. Article 7 specifies general conditions that apply to vessels operating under a national fishing vessel license. No spear guns shall be used (art. 10). Marine turtles are declared to be protected species under article 11. These Regulations make provision for the granting of fishing and other licenses to foreign fishing vessels, lay down some rules relative to operations of those vessels in Eritrean waters, and prescribe offences and penalties. No fishing license shall be granted to a vessel which is not registered with the Ministry of Fisheries (art. 3). The First Schedule provides a form of fishing license and the Second Schedule a form of a transshipment license. Article 5 concerns fees. Conditions that in general apply to operations of foreign fishing vessels are set out in article 6. Agents shall be appointed for each vessel for which an application for registration or granting of a license is made (art.7). Remaining provisions set out rules for operations of vessels such as the stowage of gear, disposal of waste matter, and the fitting out of vessels, regulate scienti8fic research (art. 17) and prescribe offences and penalties. The Third Schedule contains specifications for the marking of vessels. (22 articles)
