Los Trabajadores domésticos tendrán derecho a ocho horas diaras de descanso nocturno, a veinticuatro horas continuas de descanso semanal, en día domingo o en otro de la semana, a descanso el 1.° mayo, 28 julio y 25 dic. Si el empleador necesitara los servicios del doméstico en alguno de estos días, le abonará un salario extra.

Further strengthens the Social Security System (SSS) and Social Security Commission, and provides for the administration thereof. Coverage shall be compulsory for all employees under the age if 60 (including domestic workers, provided their income is above a specified amount), spouses engaged in full-time house-keeping, self-employed professionals, and, on a voluntary basis, Filipinos recruited by foreign-based employers. Beneficiaries shall include spouses, dependent children, and children born outside of marriage. Also sets forth benefits, which include a monthly retirement pension, dependents' pension, permanent disability benefits, funeral grant, sickness benefit, and maternity benefit.

Finally, makes numerous technical amendments to the Industrial Relations Act (Chapter 136 of the 1985 revised edition).

This Act regulates foreigners' right to admission to, residence in and departure from South Africa. Since 1994-01-01 inhabitants in Bophutatswana, Vena, Ciskei and Tanskei are no longer considered foreigners. Admission to South Africa presupposes holding a valid passport with a visa or an appropriate endorsement. The latter requirement may be waived by the Minister of Home Affairs at his absolute discretion. The Minister may also discretionarily annul granted visas or endorsements. Transit through the country is also subject to a visa requirement. Entry may only take place at certain determined ports of entry. Residence requires a permit. Temporary residence permits are issued by an immigration officer upon application prior or after entry. Permits are issued for specific purposes and time-periods and may be subjected to additional conditions. The permits can be extended to include a spouse, dependent child or domestic employee of the applicant. A fixed deposit or a guarantee may be required in order to ensure compliance with the terms of the permit. Temporary residence permits may be withdrawn at the discretion of the Minister of Home Affairs. Permanent residence requests are considered and granted at the entire discretion of an "Immigrants Selection Board", whose members are chosen and appointed by the Minister of Home Affairs. A permanent residence permit may be refused an applicant who is likely to pursue an occupation in which a sufficient number of persons are already engaged, while a permit should be granted the spouse, dependent child or other dependent relative to a lawful resident in South Africa. Emigration also presupposes obtaining a permit. Such a permit shall be granted for permanent migration and may be granted for temporaray stays abroad. Vocational traning may to be offered anyone who has not a temporary or permanent residence permit. Offences against the act are criminally sanctioned and undesireable persons may be deported.

Tiene por objeto regular la relación laboral de carácter especial del servicio del hogar familiar de acuerdo con el artículo 2.1.b) de la Ley del Estatuto de los Trabajadores, Texto Refundido aprobado por Real Decreto Legislativo núm. 1/1995, de 24 de marzo. Dispone que se considera relación laboral especial del servicio del hogar familiar la que conciertan el titular del mismo, como empleador, y el empleado que, dependientemente y por cuenta de aquél, presta servicios retribuidos en el ámbito del hogar familiar.

El Capítulo II efectúa modificaciones en los regímenes especiales de trabajadores por cuenta propia y de Empleados de hogar en materia de altas, bajas y alcances y efectos de la obligación de cotizar, dando una regulación particular para los empleados del hogar .

These Regulations prescribe the detailed conditions for obtaining a license to carry out the business of a foreign employment agency. They also determine the fees payable to the Sri Lanka Bureau of Foreign Employment by every worker due to work abroad. To the Regulations is annexed, inter alia, a model employment agreement to govern domestic sector employees recruited to Kuwait, UAE, Saudi Arabia and "other countries". Pursuant thereto the employer is required to pay the travel expenses of the employee upon assuming service. Upon the end of the contract, the employer must pay the employee, in addition to the return travel expenses, an end of service gratuity of not less than one month salary. The employer is also required to provide free accommodation, food and medical care as well as insurance coverage against accident, sickness or permanent disablement.
